Pope Urban III confirms for Rogerius magister and the brothers of the Hospital of St John of Jerusalem the masked eleemosynary grant of the lordship and castellum Margati to them by Bertrandus dominus Margati, for the needs of Christianity but also because Bertrandus can no longer bear the expenses and the close proximity of the infidels. The pope records that the grant was made with the consent of Prince B. of Antioch, with the advice of Patriarch A. of Antioch and at the will of Count R. of Tripoli. The pope incorporates the charter of Bertrandus [Feb. 1. 1187]. Bertrandus Margati dominus, the son of dominus Reinaldus, quondam ejusdem castelli dominus, with the agreement of Prince Bohemond III of Antioch, Count Raymond III of Tripoli and his wife domina Bermunda, with the advice and at the instigation of dominus Anterius Valenie episcopus, and with the agreement of all his men [homines] having ius, feudum or hereditas in the territory, both milites and burgenses, makes a sealed eleemosynary grant to the Hospital of St John of Jerusalem, represented by dominus Rogerius de Molins, eiusdem domus venerabilis magister. He gives the castle [castrum] called Margat with all its lands and rights, including his dominationes and ligiantiae. In return, the magister, his successors and brothers will pay Bertrandus and his legitimate heirs 2200 Saracen besants each year, payable in the city of Tripoli by the castellan [castellanus] of Cractum in 4 instalments, namely 550 besants each at Easter, the Nativity of St John the Baptist, the Feast of the Exaltation of the Cross and Christmas. If Bertrandus should die without legitimate heirs, the Hospital will pay Bermunda, or another legitimate wife, 1200 besants each year, retaining the balance of 1000 besants as an alms gift. If on the death of Bertrandus there are heirs, the rent should be divided, with 1100 going to his wife for her lifetime and 1100 to his heirs. The 2200 Saracen besants will thereafter go totally to the heirs, but if the line should fail, the rent will revert as an alms-gift to the Hospital. The pope also incorporates, with some differences, the confirmation charter of Prince Bohemond of Antioch. Bohemond confirms the possession by the Hospital of the dependencies of the feodum Margati: Margatum, Cademois, Laycas, Malaycas, Bokebeis, casale Belne, and in the principality of Antioch, Fassia with its guastinae and dependencies by land and sea, casale Cymas, abbatia Montis Parlerii, the villa called Russa, casale Farangi, casale Come, casale Pospos with its casale, casale Caynon, casale Aliis, abbatia S. Gregorii, which is in Montana Nigra with its casalia and guastinae, Rogia with its guastinae, casale Belmesyn, casale Besselemon, casale Luzin, caveae Belmys, casale Casnapor, casale Colcas, casale Corconai and Meunsarac which are in the mountains of Mons Parlerius, Pocania and Pangeregan which are in the vallis Russa, Andesyn, abbatia de sancta Maria, casale Bodoyke, half of the casale called Gorrosie, casale Massabe. Possession of these, with milites, homines and villani and all rights is confirmed as an eleemosynary grant, to benefit especially the soul of Bohemond’s father Raymond. The Hospital of St John is to hold all this freed from any servitium. Bohemond confirms everything that dominus Rainaldus had in Antioch, including a bath house, and [the lordship of] all the milites of the castrum of Margatum with the servitii and feodi previously owed to dominus R. Maserius and dominus B. The Hospitallers may retain all loot taken from the enemy. They are not bound to observe truces made by Bohemond with the Sarraceni. If they make truces with the enemies who are in the feudum of Bokebeis or are before Gabulum, Bohemond will observe them if notified. The Hospitallers are free to bring in or take out, sell or buy their goods throughout the whole of the principality without payment of any exaction, but if their homines sell or buy goods that are not the property of the Hospital the accustomed duty [consuetudo] will be payable to the prince’s curia. These include houses that belonged to the Knights Templar, with a tower and a platea nearby, stretching to the sea near their fondacum above the city wall; houses that belonged to the sons of the late Balduinus Pisanus near the platea by the sea and next to their fundacum; houses that belonged to Matheus Iohannis Guidi, next to the platea by the sea that extend from the houses of the sons of Balduinus to the houses of Vguicio Taliauenti and Guinus Pisanus; and houses that belonged to the king where there was a scriptorium [in which cartule were made] and which are situated beyond the Pisan fundacum. text: Oct. 1-31. Tyre. In the royal citadel. Wishing to reward those who are helping him defend Tyre and with the advice and consent of magister Monachus Cesariensis archiepiscopus, domnus Leotardus Nazarenus archiepiscopus, domnus Oddo episcopus Sydonie, frater Terri domus milicie Templi magnus preceptor and other Knights Templar, frater Burellus magnus preceptor Hospitalis and other brother Hospitallers, and the milites and burgenses of Tyre and all the comune civitatis, Corradus, the son of the marquess of Montferrat, makes a sealed grant to the comune and cives of Pisa in Acre and its neighbourhood, He confirms: their possession of land with houses, churches, ovens, a bath house and all buildings established between Caput Furoris as far as the door of [the church of] St Andrew and outside the door as far as the tarsana and on the other side from the water of the port as far as shore of the burgus novus along the road [via] that runs from the Caput Furoris, past the house of Guidotta in a straight line as far as the shore of the burgus novus and along another road that runs from the house of Martinus Cercius by the door of the baths as far as the shore of the burgus novus, together with the houses and buildings on either side of the road and an oven and the royal bath house, which are next to the doorway; all houses the Pisans have in the burgus novus and any other part of Acre; in the neighbourhood of the city, Cabor, a garden which belonged to Antelmus, and a second mill on the river of Acre by the first mill, which is next to the church of St Nicholas. Corradus concedes to the Pisans and their commune in Acre the right to use weights and measures [statera et pensae et modia et mensurae] for wine and oil and all other things, which they can use in sales to other persons. He also confirms for the comune of the Pisans in Acre a free curia. All Pisans and those leased houses by them, whether scapuli, burgenses, milites, comiti or of any lay condition whatever, should be judged in the Pisan curia, except for cases involving feoda or assisiae, which should be judged in the curiae of lords [domni]. Otherwise no Pisan shall be subject to the jurisdiction of the royal curia in Acre or elsewhere throughout the kingdom. On the other hand, the king can exact dues [talia] on the houses of Pisan burgenses situated outside the Pisan quarter [extra honorem Pisani communis] if he exacts it elsewhere in the city of Acre, but he cannot impose any other dues [dricture] because of military or other needs, and the Pisans and those who rent Pisan propertes are to be exempt from terciaria and other dues. Corradus concedes to the Pisans the right to have a vicecomes or consul to run their curia in Acre, the right to place their own men in the catena, funda and gates of the city of Acre to look after Pisans and those who rent properties from them, who are to be free from any attempt by king’s men or those of any baro to tax them on entry and departure. The Pisans are to be free from charges on shipwreck and from any charge on houses, ovens, baths, casalia, mills and weights and measures [statera, et pensae et modia et mensurae] in Acre. The heirs of Pisans who die can recover their feoda and assisiae. The Pisans have the right to have their own churches and their liberties and Corradus promises at assist them in any dispute with other churches in Acre. Because the Pisans have remained in Tyre and are fighting the Sarraceni in defence of the kingdom they will in future be freed from all servicia for the gifts that have been made to them.
