text: First half of 1170 (probably c. June). [122] Gibertus, domus [Hospitalis] sanctorum pauperum minister, with the agreement of all his brothers [universi collegii nostri] records under seal how dominus A. Hungrie, Dalmacie et Croacie dux [Bela III], who was intending to pilgrimage to Jerusalem with his wife, had transferred as an eleemosynary gift money worth 10000 gold besants to the Hospital and through his emissary Retchab and the Hospitaller brother Bernardus had asked the Order to buy lands, vineyards and casalia near Jerusalem, the produce of which would provide both for the duke and his wife in the Holy Land and after his death would provide for the poor in the Hospital. During his lifetime, if he and his wife resided elsewhere, the Hospital could enjoy the fruits. His heirs would have no rights to the properties, but should his sons wish to serve [famulari] the Hospital, the Order would provide them with horses and arms. Lands near Jerusalem were hard to find, but Gibertus and his brothers give the duke, not for money but out of love, castellum Emaus, Aqua Bella, Belveer and Saltus Muratus, all near Jerusalem with cultivated and uncultivated lands, vineyards, orchards [pomeria], woods, with wheat and barley, wine and fruits, and animals. The Hospital has also bought in the city of Acre a palatium, which belonged to the late Giraldus de Cuniculis and 4 houses belonging to Fulco Moneta, and outside the city an orchard [pomarium] and a casale 1 league [leuga] away for 11000 Saracen besants, drawn from the duke’s money. These properties will return annually 1100 besants. The duke and his wife will receive the income either from the 3 casalia near Jerusalem or from those in Acre, whichever is the greater. The Hospitallers do not yet have a charter of confirmation of the properties in and near Acre from King Amalric, who has travelled to Antioch, but they are confident of his agreement when he returns. To prevent the loss of the castles [castra] of Archas and Gibelacar, which have been destroyed by an earthquake, Amalric, dei gratia Ierosolimorum rex Latinorum quintus, Tripolitanum comitatum procurans, records under seal that he has given them to the Hospital of St John of Jerusalem and Gibertus venerabilis magister. The Hospitallers will restore them. Their possession of the castles, together with the servicia and hominium owed by homines in their domains, is guaranteed in the future. He gives the Hospitallers the right to enjoy the spoils of war gained from the Saraceni without any subtraction, unless he himself is present on campaign. If the count of Tripoli [Raymond III], who is a prisoner, should dispute these grants King Amalric will defend the Hospitallers. If the count is released from captivity King Amalric will ask him to confirm the gift. If he does not and the county reverts by hereditary right to the king, the grants will be confirmed and renewed. Amalric confirms all gifts previously made to the Order by the count and his predecessors. In the presence of Patriarch Amalric of Jerusalem, at the mediation of Heraclius archidiaconus Hierosolymitanus and magister Monachus domni patriarche cancellarius, and with the consent of both their chapters, Bernardus Liddensis episcopus and Petrus Dominici Sepulcri prior come to an agreement. Bernardus gives the canons of the Holy Sepulchre half of the tithes taken on harvests, wine, oil, beasts, fowl and other things in a casale called Bermenayn. Petrus concedes to the church and bishop of Lydda half of all the tithes of harvests of the 4 casalia, referred to in a charter of gift from Rogerius quondam Liddensis episcopus, of Capharuth, Git, Kephrecylta and Porfilia. Of these, the first 2 were given and the others exchanged. Exempted from the payment of tithes of all 5 casalia will be fodder for beasts and feeding for fowls, but half tithes will be paid on the products of the canons’ own labour. Bernardus, with the consent of his chapter, gives the canons of the holy Sepulchre the right to churches and the building of new ones in the 5 casalia, with full parochial rights, although the priests [sacerdotes] appointed by the canons should be obedient to the bishop, who retains the right to summon them to a synod, to bless the chrism and oils they need, to consecrate altars and ordain clergy, and to impose interdicts and excommunications. The rent is made up in the following way. The king has given 50 of these besants for the maintenance of one leper in perpetuity. Added to this is a rent of 10 besants, drawn from the money fief [assisia] attached to the pincernatus, which was given by Odo de Sancto Amando, and a rent of 12 besants was given by the king in exchange for a house next to the macellum in Jerusalem, which the brothers of St Lazarus surrendered to him. [125] Bohemond III, the son of Prince Raymond, Dei gratia princeps Antiochenus, with the agreement of his wife domina Orgollosa principissa, confirms under seal for the church of St Mary, the archbishop, consuls, senators and members of the commune of Pisa and its province residing in his principality land to build a house in the port of Latakia. This land extends below the church of St Elyas, before the house of the Templars [domus Templi] and the house of magister Ugo, as far as the sea, and along the seashore as far as a tannery [taneria] and the old wall, and in the upper part as far as the ditch. If the Pisans by the judgement of court [iudicium curie] can recover the land in the port occupied by Hugo Embriacus, the son of Willelmus, the land now given will revert to the prince. Bohemond gives in addition a house in the city of Antioch that belonged to dominus Odo de Tyro. He assures the Pisans of the security of their persons and goods in case of shipwreck and of the property of those who should die, except when they are intestate. He remits half of all taxes [medietas totius iuris] customarily paid on entry and departure, coming and returning, buying and selling, throughout his territory and he assures them of his protection. Disputes between them can be settled in their own court [curia], but if a case cannot be decided, or involves theft, predation, homicide or the subjects of Antioch, it will decided in the prince’s court.
