text: 23 Dec. In the Christian army at Damietta. Barzella Merxadrus, a crusader from Bologna, makes a will while gravely ill. He leaves 5 besants to be spent on his funeral, burial and for Requiems by his executors, the dominus presbiter Egidius, his wife Guilletta and his uncle [barbanus] Rainaldinus Maldinarus. He leaves his arms and armour and his coat of mail with one arm plate and a hood to the Hospital of St Mary of the Germans, in the cemetery of which he wishes to be buried. He makes an eleemosynary grant of the following from his goods in the army as a subsidy to a man who is willing to remain in the army until next Michaelmas: 2 sacchi of biscuit, 2 modii of flour, 2 corbae of wine, a quarter of a mezzina of meat, a pair of breeches, a shirt and 6 besants for sharing bread and wine. He leaves 1 besant to the presbiter Egidius to sing Masses, 2 besants to Rainaldinus Maldinarus, 5 small imperial solidi to Corradinus de Ponteclo and 3 besants to his companions, to whom he leaves part of the tent and its furniture, to be shared with his wife Guiletta. They should assure her peaceful possession of her section of the tent and its furniture [massaratici] while she is in the army. He leaves 2 besants to Iacobus de Ulgiano notarius, 1 besant to the Leprosary of St Lazarus, 1 besant to the army’s common chest, 1 besant to the Templum Domini and 1 besant to the Hospital of St John of Jerusalem. He makes a further eleemosynary grant of 5 besants to the presbiter Egidius for the repose of his soul. He makes his wife Guiletta heir to all his movable and immovable goods and rights in the army overseas and to his share in the spoil of Damietta. He makes his mother Berta and brother Blasius heirs to all his goods in Bologna. He makes the gift in appreciation of the services he has received from the Order while in Syria. He wishes to receive the Order’s habit on the day of his death and to be buried in its cemetery. He asks his wife A. and son B. to carry out his wishes. On account of the religion and good reputation of the brothers of the Hospital of St Mary of the Germans, he gives them his share of loot in future warfare when they are campaigning with his homines under the royal banner [cum signo regali], although he is absent. When he is present he will retain his share, which is half of all booty taken in towns [villae] or castles, in the field or in an expedition. Pope Honorius III confirms for the abbas and convent of Episcopia the eleemosynary grant made by the late King Hugh of Cyprus to the late I prior ecclesie Sancte Marie Montis Cyrinarum, Ordinis Sancti Augustini, and his successors of the place [locus] Taylus, in which the abbey is situated, and the place called Episcopia. The pope also confirms the abbey’s freedom and immunity from tithes, granted by the late Alanus Nicosiensis archiepiscopus with the agreement of his chapter, saving the obedience that Cistercians customarily accord to their bishops.

Frederick, secundus divina favente clementia Romanorum imperator semper augustus, Ierusalem et Sicilie rex, draws attention to the favour shown by his predecessors and those of his wife Isabella [II] Romanorum imperatrix semper augusta, Ierusalem et Sicilie regina, to the Hospital of St Mary of the Germans in Jerusalem and praises that Order’s achievements, referring especially to frater Hermannus magister domus and his other brothers. He makes a sealed eleemosynary grant to them. He confirms all their acquisitions in the kingdom of Jerusalem, which has come to him in dowry [nostrum dotale Ierosolimitanum regnum]. With the agreement of his wife, he confirms the sale to them by comes Otto de Hennenberhe/Hennberac, his wife Beatrix, the daughter of comes Ioczolinus, and their son Otto of Castellum Regis and its dependencies, except for the casale called Iahron, according to the charter of confirmation issued by King John, which listed the dependencies and casalia of Castellum Regis: Tersyha, Carphasome, Samohete, Geelin, Zoenite, Beletini, Tarfile, Rasapde, Supheye, Caphara, Nesechie/Nesecchie, Danehile, Labeyne/Labeine, Iubie, Bethera, Abelie/Habelie, Amca, Geze, Clil and half of Noie, Phasoce, Acbara, Tayeretrane, Tayrebicca, Phennes, Carsilie, Serohu, Gabatie, Orfeis, Roeis, Campsara, Capsie, Deleha, Derbasta, Rapho, Rabeb, Ezefer, Berzei and a third of the feodum of Sanctus Georgius, the dependencies and casalia of which are Archet, Yanot, Cabra, Meblie, Sapher, Lemezera, Kemelie and a third of the casale of Boukeel, together with a third of the assisia attached to the feodum, namely 266 and two-thirds besants, being a third of [the rent of] 800 besants assigned on the cathena of Acre, which the Hospital of St Mary surrendered to King John, a further assisia of 2000 Saracen besants assigned on the cathena of Acre, and the house in Acre that had belonged to comes Iocelinus/Iozolinus. The Hospital of St Mary surrendered to King John its rights over properties in this sale that are now in the hands of the Sarraceni. Frederick returns the right to these properties to the Order, so that in future it will hold the entire inheritance of Beatrix from the lands of comes Iosolinus/Iozolinus, except for the assisia in besants from the catena of Acre that the magister and brothers surrendered to King John. Frederick also confirms the eleemosynary grant by Henricus Trecensium comes palatinus, with the agreement of his wife Isabella [I], the daughter of King Amalric, of the barbacan, towers, walls and fosse [in Acre], measured and stretching as far as the Gate of St Nicholas. Guillelmus de Keviller, the son of dominus Petrus de Keviller, records that he gave Girinus, the prior of the Hospital of St John of Jerusalem in France [Francia] a rent in return for assistance from the magister Hospitalis in gaining the release of his father, who was imprisoned in a castle of the Sarraceni commonly called Saona. Guillelmus travelled to Syria, where he met frater Guarinus de Monte Acuto magister Hospitalis, who agreed to do what he could. But in the middle of the negotiations his father died, although had he survived, his freedom would have been gained. He now confirms his gift as an eleemosynary grant in the presence of dominus Galterus castellanus de Rassa; dominus Johannes de Aubeigny; Lamfridus clericus et nuncius domini regis Francie; and Gerardus clericus et filius dominus Durandi de Fuer. He has no seal and therefore asks the prior Dominici Sepulchri, representing the patriarch of Jerusalem, to seal for him.

He gives a mill outside the walls of Antioch, situated on the river fer, below the patriarch’s mill, which he had bought and repaired. The mill has 3 millstones [peires] and the Hospital of St Mary of Germans has licence to install a fourth. The mill’s dependencies include a fishery [pescherie].
