Aimery confirms the eleemosynary gifts and old freedom [francisia] granted to the hospital in Cyprus by King Amalric. Iohannes de Ybelino domnus Beriti et regni Ierosolimitani baiulus records how Iohannes Tortus came into his presence, and that of the High Court [regalis curia] and asked of Iohannes de Ybelino and the vassals [homines] of the Lady Maria, regni honorabilis domna, licence to sell his house in Acre to settle his debts. After taking counsel from the vassals of the Lady [Maria], Iohannes de Ybelino judged that the licence could not be granted. On the response of Iohannes Tortus that he would have to sell either his fief [feodum] or his house to pay his debts, the court decided to change its decision and permit Iohannes Tortus to sell his house in order to retain his fief. And so, in the presence of the baiulus Iohannes de Ybelino, who sealed the charter, and of the High Court [regalis curia] and with the agreement of Maria, the wife of Iohannes Tortus, his sister Beatrix and her husband Willelmus de Monliart, Iohannes Tortus sold his house to the Hospital of St Mary of the Germans in Acre for 2700 Saracen besants. The house is bordered on the east by the houses of Mt Tabor and of Beloais, the royal way [via regia] and the houses that belonged to Petrus Bordin, on the west, by the house of Bonefrage filius Sahit, the rua Judeorum, the house of the Jews and the stable [stabulum] of Renerius scriptor, on the north by the house of Maria, the wife of the late priest of the church of St Mary Magdalene, and on the south by the royal way [via regia] and the house held by domna Hauhis of Iohannes Tortus. In return for her agreement to the surrender of this house, the brothers of the Hospital of St Mary have given Hauhis 300 Saracen besants and 2 marchae argenti. The Lady Maria has had 200 besants from the brothers of the Hospital for her agreement to the sale. The gift comprises land, bought by Garnerus from Iulianus de Faloisse, in which there is a lime kiln [calidus furnus]. To the north is a road and to the south a hill. Garnerus also gave a garden, bordering on the south the threshing floors [areae] of Tarsia. In that land there is a corner of wasteland and on the western side is a mulberry tree [morus] and a field called Migramme. Above is a piece of land [frustrum terre] bordering on the land of the house of the Holy Sepulchre and on the east, towards the hill, is some land and a half-ruined vouta, in which there is a cistern and a wine-press [vrequinnus ad racemos decalcandos]. A further 3250 besants is to be paid by the magister and brothers to settle a debt to domnus Guillermus de Amigdala, who was married to the sister of Beatrix. The sale covers all these properties, whether or not they are in the hands of the Sarraceni, but the brothers surrender to the king their rights to those possessions which are in Muslim hands. Oto and Beatrix sell the house in Acre that had belonged to comes Iocelinus. It is bordered on the east by a lane [ruella], on the west by the cloistered house belonging to the abbot of Mt Tabor, on the south by the public way and on the north by the house of Rohardus domnus Cayphe. If there are other houses in Tyre of Acre that should have been included in this inventory, the magister and brothers can apply to the royal court, where they will receive justice according to custom [plenum ius secundum consuetudines]. King John records that for his agreement he has received 500 marchae argenti from the magister and brothers. text: Apr. 20. Acre. Iacobus de Amigdala records under seal that he has come to an agreement with the magister and convent of the Hospital of St Mary of the Germans. He accepts an annual rent of 6400 Saracen besants, which the emperor Frederick, king of Jerusalem and Sicily, gave the Order, in exchange for his feudum, which came to him by legitimate succession through his mother, the daughter of comes Iozcelinus. Among the casalia in his fief is Mobilir, given to him in exchange for Trefile and castrum novum, called Montfort, which the Order is now fortifying, and for a garden and a mill that are dependencies of Trefile. Other casalia are: Ialim, Tharbucha, Tarbosta, Suru, Beauer, Camesru, Tetramme, Fennes, Tersias, Ianot/Ianoth with a dependent gastina called Hemelie, Getz, Cabbara with a gastina called Camesie, Iunite, Blutun and Castrum Regis. Excluded from the sale are those possessions the Order held at Castrum Regis before they acquired the lordship and everything it bought or received in eleemosynary grants. Iacobus and his heirs will receive the rent from the revenues of the cathena and funda of Acre, payable in 4 instalments of 1600 besants. If the rent should fail magister Hermannus and his successors and the Order are held to pay Iacobus and his heirs 3200 Saracen besants within 6 months or they will restore the entire feudum to Iacobus, except for the castle of Montfort, because the site was given in exchange for Mobilie. This agreement will be enforced by the High Court [curia regis]. If the 3200 besants are not paid within 20 days tthe Order will pledge the casalia of Erchat, Saphet and Ancre. If at the end of six months the debt is still not paid, Iacobus and his heirs can dispose of these 3 casalia as they wish.
