[113] Bohemond III, son of Prince Raymond, Dei gratia princeps Antiochenus, makes a sealed eleemosynary grant to the Hospital of St John of Jerusalem, Girbertus Hospitalis magister and his brothers. He gives Rochefort with an abbatia, Cava, Levonia, Tala, Bachfela, Gaigon, Glorieta with a spring that waters the gardens, casale S. Egidii with the torone de Belda, half of Rogia together with the other half which Bohemond has acquired from Reinaldus Masoerius and his heirs, Arcicant, Farmith, Femia with its lake, Logis, Bochabes with the casale de Pailes; other lordships and liege lordships [dominationes et liggianciae] that Femia has in Syria, Berssaphut, castellum de Lacoba and Totomota. With the consent of the inhabitants, Bohemond concedes all these, together with his lordships and liege lordships in them, with the agreement of those who have rights, feoda and heritages. The Hospitallers can make war and peace with neighbouring Muslim powers as they please and, when notified, Bohemond will observe them. On the other hand neither he nor his homines will make treaties with the Sarraceni, nor with any Christians allied to them, without the advice of the Hospitallers. If the Hospitallers are not consulted they can react as they please. They can enjoy all the proceeds of the spoils of war. Bohemond confirms the privileges granted by his father of free import or export of goods without the payment of any tax [consuetudo et exactio curie] All gifts made by his homines will be confirmed, provided that the number of knights’ fiefs [feodum militis] are not lessened and his curia loses servicium. The pope also confirms the right of the prior and canons of the Holy Sepulchre to celebrate stational Masses at and process to the Templum Domini, the Mt of Olives, Mt Sion and St Mary of the Valley of Jehoshaphat on their feasts, even when the patriarch is absent. They also have the right, in the patriarch’s absence, to excommunicate malefactors in their parishes, especially those who withhold the payment of tithes. None of their goods can be alienated or pledged, except by the common agreement, or that of the wiser part, of the canons; nor can anyone be sent overseas, suspended or expelled, unless his fault is manifest. Confratres can receive communion from the canons and be buried in the canons’ cemeteries unless they are excommunicated. The patriarch cannot extort goods from the canons and confratres. The canons are freed from payment of tithes on noval lands, cultivated by themselves or at their expense, or providing animal fodder. The election of priors by the canons is to be free from interference. The pope renews his protection of the Holy Sepulchre.

Amalric, per gratiam dei in sancta civitate Ierusalem Latinorum rex quintus, confirms under seal for Paganus de Caypha and his heirs, born of his marriage to the daughter of Iozelinus/Iozellinus/Iocelinus Pesellus whatever his brother King Baldwin III gave to Iozelinus and his heirs. The gift consisted of a [money fief of] 1200 Saracen besants, to be received each year from the cathena of Acre, in return for the servitium of 2 milites, and the first feodum in the kingdom [carrying the service] of 20 milites - or less should Iozellinus or his heirs require it - that would come into the king’s hands, in which case the money fief of 1200 besants would revert to the king. In addition, Baldwin gave Iocelinus and his heirs a feodum [carrying the service] of 100 milites in Egypt [Babylonia] when it was conquered by the Christians. Amalric confirms for Paganus de Caypha and his heirs [a money fief of] 600 besants, to be received annually in 4 instalments from the funda of Acre, which King Baldwin had given to Iocelinus Pesellus in augmentation of his feodum, in return for the servicium of 1 miles. Amalric also confirms the rent of 500 besants, received annually from the macellum of Acre in 4 instalments, which Amalric had given Fulco Tiberiadensis as part of the arrangement underlying the gift by Amalric of the castle [castrum] of Saphet to the Templars [milicia Templi]. This rent of 500 besants was given by Fulco to Paganus in exchange for Giboseuart. He specifies: a ruiga with the church of St John in Antioch, which is between two streams [aquae] and has the road [via] on each side; a fundicum, a ruga and everything else they have in Latakia, together with a third part of the revenues [redditus] of the port; a third part of the revenues in Suidinum. He promises a response to complaints or justice with 40 days, unless hindered for a good reason; and in that case emendment with 15 days according to the usus et institutiones of his curia. He gives [freedom from] conmertium in all his land and in any territory he acquires with Genoese assistance. He promises security of Genoese persons and possessions.
