Petrus prior Dominici Sepulcri records that, together with some of his canons, he travelled from Jerusalem to Antioch to investigate the rights enjoyed by the church of the Holy Sepulchre in the time of the Greeks [Greci] and then under the Turks [Turci]. He found 2 mills, one standing, the other ruined, on the banks of the River Orontes at the head of the bridge leading to the Gate of the Count [of the city], which the Holy Sepulchre had once owned by hereditary right. Having investigated the matter with lord Raymond [of Poitiers], princeps ejusdem civitatis, and husband of Constantia and having taken evidence from elderly Suriani, it was agreed to put the 2 water wheels [duas rotas a parte fluminis] at [one of] these mills, called Funeidec, into the custody of three Suriani called Nicheforus, Michaelis and Nicholas for them and their heirs to hold in feodo villaniᶒ on condition that they meet the expenses in materials required in rebuilding the mill and the barrage [exclusa] for the mill race. In return they will have half of all the profit they make from milling and from fishing, although the division of produce between them and the Holy Sepulchre will only take place in the presence of the canons’ famulus, who will hold the key to the mills. If the mill should be damaged the Syrians will rebuild it; on a third refusal to rebuild the mill will be confiscated. If a miller is convicted of theft he will repay either in marcibans or in besants. If he cannot repay the money will be expropriated by a canon or by the canons’ famulus. The villania cannot be sold or pledged without the permission of the chapter of the Holy Sepulchre. Constance, Dei gracia Antiochenorum principissa, records that Adelicia Laodicie principissa, who had unjustly seized the land of the sons of Radulfus Boerius and had granted it to Guarnerius de Burgo, had recognized her fault in the presence of Geraldus Laodicensis episcopus and other good men and had ruled that the land should be returned to the sons of Radulfus. The land had been inherited in the meantime by Martinus Gelnus, who now restored it to the sons of Radulfus in the presence of Constance and the barones of Latakia. The sons of Radulfus have sold the land to the Hospital of St John of Jerusalem, represented by frater Willelmus, who presides over the commandery [domus] of the Hospital in the principality of Antioch [in Antiochenis finibus]. Constance herself concedes whatever rights she has on the land and adds 2 carrucatae terrae in the Guastina Putei adjoining it. Witnesses: G. Melisende, divina largiente clementia Iherosolimorum regina, with the consent of her sons King Baldwin III and Amalricus Ioppensium comes, renounces under seal her claims against the canons of the Holy Sepulchre, with respect to the villani of Bethsuric, namely Selmen filius Maadi; Habderahmen; Selim; Hasem; Nasen; Mekedem/Melpedem/Melpeclem; Seleemen; Sade; Brahin; Kannet; Nasser; Ariz; Mahmut; Zafer; Demsis; Resselem; Tameh; Rosec; Sahe; Salem filius Sade and the others, and the land in the casale. The canons are to have these as freely as they did in the time of Duke Godfrey [of Bouillon]. Raymond III dei gratia comes Tripoli, the son of Count Raymond II, records how Landulfus filius Johannis comitis Mauronis, Mansus Curiali, Lucas Florus, Leo Falangon, Boamundus filius Johannis Marchisani and other probi homines of Amalfi came to his court [curia] and in the presence of his homines, milites and burgenses complained [about the behaviour] of Homodei Mimol, his wife Sibilia, the daughter of Guillelmus Guersus, and Guillelmus Guersus himself in relation to certain houses [in Latakia] belonging to [the church of] St Andrew and the commune of Amalfi [commune Malfitanorum]. The Amalfitans demonstrated by witnesses that they had bought the houses, together with others in the funda. By the court’s judgement Homodei, his wife and father-in-law are to receive 600 Saracen besants. The houses are restored by Count Raymond and his court to St Andrew and the Amalfitans, who will not be liable for servitium. They are bounded by the house of the vicecomes, by houses that once belonged to Stefanus de Nimen and Oliverius pater Carbonelli, by the Tutius vicus in which many things are sold and by the road that runs to the sea towards the house of dominus Rainoardus. Landulfus and his companions, on behalf of St Andrew and Amalfi, give Count Raymond 1200 Saracen besants for his judgement and promise to maintain the count, his land and honour. Gaufredus de Donjon sancte domus Hospitalis Christi pauperum magister Hospitalis with the unanimous assent of all the Order of the Hospital of St John of Jerusalem, including the chapter, makes a sealed grant, restoring to the church of Valenia [ecclesia Valaniensis] and its bishop Anterius the right to take all those tithes of the lordship of Margattum that it was accustomed to enjoy in the time of the late dominus Rainaldus, with some exceptions. The church will have full tithes from casalia and their produce, carragia and rents; half tithes on the returns of poultry, eggs and cheese; whole tithes on the returns from the funda, platea, dyeworks and other revenues of Margatum. Full tithes will also be paid on the revenues of mills, except for the Order’s milling; half tithes on produce sold from gardens in which the Order has worked with its own labour and and at its own expense, but if any garden be rented out, full tithes will be paid. Half tithes will be paid on oil, but if the olive groves are rented out whole tithes will be due. Half tithes will be paid on carrucae and vineyards worked directly by the Hospital. Whole tithes will be due from the port, as in the days of lord Rainald, on grape juice [must] and wine, sumach, almonds and figs, jars, pots and pitchers. 15 Antiochene besants a year will be paid in place of tithes on the oven, unless it needs to be repaired, when tithes will be reduced while it is out of use. On five feasts - Easter, Pentecost, the Nativity of St John the Baptist, the Assumption of St Mary and All Saints - the Suriani and Armeni outside the town [suburbii], who have donkeys, will bring 10 somae of myrtle [mirtus] to the church of Valenia, which will enjoy freedom in all things as in the days of dominus Reinaldus. Bohemond, the son of Prince Bohemond of Antioch, Dei gratia Tripolis comes, records under seal that out of fear for the lord of the Assassins [dominus Assessinorum] he has come to an agreement with frater Gaufridus de Donjon magister sancte domus Hospitalis Iherusalem and the brothers of the Hospital of St John of Jerusalem over the lordship of Maraclea and Camelum, which he gave them and they have possessed for some time. At Bohemond’s request the Hospitallers allow him to hold the lordship for life on condition that if the Hospitallers have the agreement of the legitimate heirs to the lordship, it will revert to them. The lordship will be restored to them on Bohemond’s death. If the lordship reverts to the Hospitallers, they will pay Bohemond within a month 6000 Saracen besants for Camelum and will absolve Bohemond from his debt to them of 300 besants. This written agreement will then be returned to them.
