text: Feb. 21. Viterbo. Pope Gregory IX informs the emperor Frederick of the result of negotiations in his presence between the magister of the Hospital of St Mary of the Germans, representing the emperor and his son Conrad, and Henricus de Nazareth miles Acconensis and Ph. de Trecis miles Acconensis, representing the nobles and citizens of Acre and others in the kingdom of Jerusalem. Frederick and Conrad will enjoy all the rights of the crown as they existed before the discord arose. Their balivi will be obeyed in the management of castles and offices, the collection of rents and other rights, known to accrue to the crown by custom, saving the ancient assisii and approved customs of the kingdom. The opponents of Frederick will dissolve the commune, take down its bell, dismiss the consules and capitanei appointed since the discord arose and swear fealty. Riccardus Filangerius will be restored to the office of bailli [baiulatio], but he will appoint another who is above suspicion on the advice of O. comestabulus Acconensis to rule until next September. From then on, the prince of Antioch will be instituted baiulus on Frederick’s authority. Swearing to abide by the customs of the kingdom, the prince will hold all crown rights in the kingdom of Jerusalem, together with the city of Tyre, although the citadel of Tyre will be held by the magister and brothers of the Hospital of St Mary of the Germans. If the prince of Antioch cannot or will not accept the office, the emperor will appoint the comestabulus Acconensis as baiulus, with the powers already described. Should the need arise to replace him, another baiulus, who is above suspicion in the eyes of the liegemen of the kingdom [homines ligii regni], will be appointed to serve until Conrad comes of age. In return the emperor will assure all in the kingdom, clergy and laity, nobles and citizens of Acre, of his grace. His favour should extend to Iohannes de Ibylino, his sons and supporters, and all living in and coming to the kingdom, including merchants, but safe-conducts will not be extended to Iohannes de Ibylino, his sons and nephews, specifically Iohannes de Cesariis and the other Iohannes de Ybelino, should they travel outside the kingdom. Any case brought against Iohannes de Ybilino or his followers will be judged according to the customs and assisii of the kingdom. The pope adds that he has ordered the bishops of Acre and Chieti to denounce those who do not hold to their promises and he encourages Frederick to observe this agreement. He writes in similar terms to the magistri and brothers of the Hospital of St John of Jerusalem, and the Hospital of St Mary of the Germans, the preceptor and brothers [in Acre] of the Hospital of St Mary of the Germans, O. comestabulus Acconensis, B. dominus Sydonis, Iohannes de Cesariis, the nobles and citizens of Acre and others in the kingdom of Jerusalem, and the bishops of Chieti and Acre.

Johan sire de Cesaire and Jehan de Ibelin promise to be guarantors of the sale made by King Henry of Cyprus to the church of Nicosia [before 1-31 September 1236], the text of which they incorporate in the record of their deed. Should the king default, they promise to help the church recover the 24000 besants owed to it if the sum has not been paid by the following April, but if they have to raise the money themselves, the church will surrender to them for 3 years the income of 2000 white besants it should have received. The rent, payable each year on the Feast of the Nativity of St John the Baptist, is 15 Saracen besants of Acre weight. The brothers of St Lazarus can build on the site, as far as the sea, but should they wish to sell, the Knights Templar will have preemption rights. The rent will still be payable. The site may not be sold or pledged to religious houses, men from the [merchant] communities or secular milites. The Knights Templar will keep the street in repair to allow the brothers of St Lazarus access to the water in their cistern, which is on the other side of the public way next to a house and boveria of the Templars. The Hospital of St Mary of the Germans is held to pay the Hospital of St John of Jerusalem one quarter of the revenue of the casale called Arabia. St Mary will appoint a bajulus, enjoined by the magister Theutonicorum or his lieutenant in the presence of the preceptor of the Hospital of St John to make the payment, taking only moderate expenses for himself, until St John has been repaid the 5000 besants for which the casale has been pledged by St Mary. The barons, knights and citizens [barons et chevalers et citeens] of the kingdom of Jerusalem, represented by Balien d’Ybelin seignor de Baruth and his brothers and Iohan d’Ybelin, present their proposals for peace in the kingdom, to be transmitted to the emperor Frederick. They require his favour and his pardon for all misdemeanours committed to the present in the discord in the land. They ask that he appoint as his bail over all the kingdom mon sire Simon de Montfort conte de Leicestre, to hold office until King Conrad comes of age or until the king comes out to the Holy Land or appoints Simon’s successor. Simon should swear to preserve the rights of the emperor and son King Conrad and to govern in accordance with the usages, customs and assises [par les ous et les costumes et par les assises] of the kingdom of Jerusalem. In return the barons and others will swear to obey the bail and will surrender the bell, consuls [conseles] and captains [chevetaines] of the commune, save those in post before the emperor became lord of the land. Frederick should record his agreement to this form of peace under seal. Patriarch Albert of Antioch, the papal legate, records his sealed arbitration, which has been agreed by Bohemond, par la grace de Deu prince d’Antioche et conte de Triple, and frere Pierre de Vieille Bride, maistre de la sainte maison del Hospital de saint Johan de Jerusalem on behalf of his convent. The parties have been engaged in long dispute over the lordship of Mareclée and Chamel and its dependencies. The Hospital of St John of Jerusalem renounces in favour of Bohemond all rights it has over Mareclée and its lordship and Chamel, putting all the charters had from Prince Bohemond [IV] into the custody of the Hospital of St Mary of the Germans and promising not to raise the issues in any ecclesiastical or secular court. The maistre of the Hospital of St John and the prince have issued sealed deeds, confirming that Mareclée will be in the custody of the Hospital of St Mary until the heir comes of age. In return, Bohemond grants the Hospital of St John an annual rent of 1300 Saracen besants in Acre weight, to be paid quarterly and drawn on the prince’s rent [assize] on the chaene d’Acre, or, in case of failure, the fonde de Triple, or on the savonerie, or on the tanerie, or on the bocherie, or on all the rents inside or outside Tripoli. Bohemond will put the heir in possession of Mareclée, with Renaut Barlais as baill, and the heir will enjoy all the rights that his father Johan de Ravandal had at the time when he made fealty to the Hospital of St John for Mareclée. Bohemond promises not to molest the heir, Renaut Barlais and Renaut’s wife Agasse. Renaut will pay liege homage [fait ligesse] to the prince until the heir comes of age. When the heir is 15 years old he may subject himself either to the lordship of the Hospital of St John or to that of the prince; if to the prince, the maistre and brothers of the Hospital promise on their habit and arms [sur lur habit et sur lur armes] not to put pressure on the heir. Since matters will be restored to the state they were in when the dispute broke out, the prince will recover a rent of 1500 besants, 400 jarres of wine and casale Tolee.
