Raymond II, Dei gratia Tripolitanus comes, and his wife Hodierna Tripolis comitissa, daughter of the king of Jerusalem, record that at the request of Patriarch William of Jerusalem, who was returning from Antioch, and of his suffragans, Fulcherius Tyrensis archiepiscopus, Robertus Nazarenus archiepiscopus, Bernardus Sydoniensis episcopus and many others, who were with him, they gave the church and canons of the Holy Sepulchre freedom to import and export through the port of Tripoli anything they needed without paying duty. Raymond and Hodierna add a sealed eleemosynary grant, confirming everything given to the church and canons of the Holy Sepulchre by Count Raymond of St Gilles, his nephew William Jordan, Counts Bertrand and Pons and all the barones or terrarii, with the exception of Sanctus Georgius [in Montanis]. Pope Alexander III renews for Nicholaus prior and the canons of the Holy Sepulchre the papal protection granted them by his predecessors Popes Honorius II, Innocent II, Celestine II, Lucius II and Eugenius III and he confirms their possessions, referring specifically to confirmations by the patriarchs of Jerusalem of the grants of half of all oblations to the Holy Sepulchre; oblations to the relic of the True Cross, except on Good Friday and when the patriarch has need of them; the tithes of the city of Jerusalem and lands around, except for those from the funda; and the church of St Peter in Jaffa. He confirms the possessions and rights of the canons of the Holy Sepulchre in the Iberian peninsula [Yspania]. He exempts them from the payment of tithes on noval lands, cultivated by themselves or at their expense, and on animal fodder. He forbids the transfer of brothers from the community without the licence of prior and chapter.

text: Feb. 13. Lateran. Pope Celestine III follows his predecessors Popes Honorius II, Innocent II, Celestine II, Lucius II, Eugenius III and Alexander III in taking Gaufridus prior and the canons of the Holy Sepulchre under protection. He renews their privileges and confirms their endowments. He states that in the absence of a patriarch the prior and canons will be responsible for managing the patriarchal house and familia. He confirms the freedom of prioral elections and the celebration by the prior of the stational Masses at the Templum Domini, Mt Sion, the Mt of Olives and St Mary of the Valley of Jehoshaphat in the absence of the patriarch. The prior and canons also have the right, in the patriarch’s absence, to excommunicate malefactors in their parishes, especially those who withhold the payment of tithes. None of their goods can be alienated or pledged, except by the common agreement, or that of the wiser part, of the canons; nor can anyone be sent overseas, suspended or expelled, unless his fault is manifest. Confratres can receive communion from the canons and be buried in the canons’ cemeteries unless they are excommunicated. The patriarch cannot extort goods from the canons and confratres. The canons are freed from payment of tithes on noval lands, cultivated by themselves or at their expense, or providing animal fodder. The pope also confirms half of the properties held in common with the patriarchate itself in England, Dacia, Germany, Poland, Ruthenia, Georgia [Auagia], Hungary and Constantinople.

John, per dei gratiam Latinorum Ierusalem rex decimus et comes Brene, and the Lady Queen Maria his wife confirm under seal for Santius Dominici Sepulcri prior and the chapter of the Holy Sepulchre the canons’ purchase of a garden near Acre, together with houses and land around the garden, from Willelmus Pomaranus. In an eleemosynary grant, John and Maria renounce any rights they have had over the garden and allow the canons to import the produce [fructus et herbae] on their horses into Acre and to sell it without the payment of dues [exactio].
