text: Feb. 13. Lateran. Pope Celestine III follows his predecessors Popes Honorius II, Innocent II, Celestine II, Lucius II, Eugenius III and Alexander III in taking Gaufridus prior and the canons of the Holy Sepulchre under protection. He renews their privileges and confirms their endowments. He states that in the absence of a patriarch the prior and canons will be responsible for managing the patriarchal house and familia. He confirms the freedom of prioral elections and the celebration by the prior of the stational Masses at the Templum Domini, Mt Sion, the Mt of Olives and St Mary of the Valley of Jehoshaphat in the absence of the patriarch. The prior and canons also have the right, in the patriarch’s absence, to excommunicate malefactors in their parishes, especially those who withhold the payment of tithes. None of their goods can be alienated or pledged, except by the common agreement, or that of the wiser part, of the canons; nor can anyone be sent overseas, suspended or expelled, unless his fault is manifest. Confratres can receive communion from the canons and be buried in the canons’ cemeteries unless they are excommunicated. The patriarch cannot extort goods from the canons and confratres. The canons are freed from payment of tithes on noval lands, cultivated by themselves or at their expense, or providing animal fodder. The pope also confirms half of the properties held in common with the patriarchate itself in England, Dacia, Germany, Poland, Ruthenia, Georgia [Auagia], Hungary and Constantinople.

Aimery, Dei gratia rex Cipri et regni Jerosolymitani comestabulus, makes a sealed grant to Joscius Tyrensis archiepiscopus, giving him the casale in Cyprus called Levadi/Livardi/Livadi for his lifetime with all its rights and villani, as were previously held by Minas turcopulus. He gives the archbishop the right to all the produce and the freedom to export it without any exaction. After the death of Joscius the casale will pass to his nephew Simon and after Simon’s death to the church of Tyre. With the agreement of his wife domna Ysabella regis Amalrici filia, Aimery, per dei gratiam rex Ierusalem nonus et rex Cipri, records under seal that he has sold the Hospital of St Mary of the Germans a casale in the region of Acre called Aguille with its villani and gastinae for 3000 Saracen besants. He adds the following gifts: the right to take a rotula of sugar each day from the sugar press [masarium] in his casale called Fiergio for the needs of the sick in the hospital; in Casale Vmberti and his other casalia in the region of Acre the right to take each year 1 clicha of wheat and 1 clicha of barley from every worked carruca, to be provided by the rustici; 5 carrublae paid by the rustici for every 100 goats wintering in Aimery’s land, and 2 out of the 10 carrublae which Aimery levies for every 10 goats; 3 karrublae provided by the rustici for every carrucata owing Aimery 2 besants. Aimery confirms the eleemosynary gifts and old freedom [francisia] granted to the hospital in Cyprus by King Amalric. With the agreement of his wife Isabella, the daughter of King Amalric, Aimery, per dei gratia Ierusalem Latinorum rex nonus et rex Cypri, confirms all previous gifts made to the commune of Marseille by kings of Jerusalem, in return for its assistance in acquiring their kingdom. They confirm especially whatever Marseille has in Acre and all the maritime cities through charters from King Fulk and King Amalric. In return for the assistance of Marseille in bringing aid to Jaffa and the kingdom of Cyprus with 2800 Saracen besants, the commune has freedom to enter and leave, sell and buy in Cyprus, without the payment of dues. He also gives one of the royal casalia in Cyprus, called Flacie, with all its rustici and animals. E. [Aymar Monachus] patriarch of Jerusalem and Iossius archiepiscopus and all the prelates are instructed to excommunicate all who challenge these confirmations and gifts. text: Oct. 12. Acre. In palatio sancte Marie Latine. With the agreement of his chapter, Tebaldus Acconensis ecclesie episcopus seals an agreement with the consules of the Pisans in Acre, Guido Paganus, Enricus Magialis and Ugo Leimattilde, on the parochial rights of the Pisan church of St Peter. The priest there has the right to baptize, hear confessions, bury and visit the sick among the Pisans who are taxed as Pisans. The rights to marry extend over the area of Acre that stretches from the church of St Laurence to the porta Tarsane and from the Caput Furoris to the Burgus novus, but saving the rights of the churches of St Andrew and St Michael. If those outside this district wish to marry in the Pisan church, half the oblations must go to the cathedral clergy. Any non-Pisan living in the district is free to marry in whatever church he wishes, unless he wishes to marry a Pisan. The priest of the Pisan church should go once a year to the mother church of Acre to receive the oil of chrism. The Pisans should not receive those excommunicated by the bishop, but the bishop promises always to give the priest of St Peter each year oil of chrism and oil of the sick. The consules promise to pay annually on the Feast of All Saints a census for the church of St Peter of 4 Saracen besants, and and they will pay a rent [census] of 12 besants on the Feast of All Saints for the tower they have built on church land. And so he makes a grant, signed in both Armenian and Latin, to Ogerius de Pallo, representing the Genoese. He gives freedom to come and go and sell throughout his land, entering and leaving through his ports. He gives the Genoese and their goods and merchandise safe conduct thoughout his land and those of his barones, so that the Genoese are freed on their purchases and sales from all servitium, drictura, pactum, exactio, angaria tributi vectigalis. Their goods are to be safe in shipwrecks. He gives land in his cities of Sisum, Mamista and Tharsus, so that in each the Genoese may build a church, a fundum, houses and a curia, in which they will have jurisdiction over Genoese, although if a Genoese has a claim against a man of another nationality the case will be decided in the royal curia. The Genoese are held to defend the rights of the king and men [of Cilician Armenia]. Leon, son of Stephen of the powerful family of Rupinids, dei gratia rex Armeniorum, makes a sealed grant to the doge and citizens of Venice, represented by Jacobus Badoarius, the son of the knight Johannes Badoarius, the emissary of the doge, who has a safe-conduct. He gives all Venetians freedom to go and return to his cities, ports and bridges with their merchandise, to buy and sell and export without paying dues [servitium, drictura, angaria et passagia], except when they are permanenly resident in the East and have come from other ports in the Levant, when they will pay as do all Christians, and except when they bring in silver and gold and mint besants or money, in which case they must pay the same dues [drictura] as do those in the territory of Acre. They will be safe if shipwrecked. They will be free to travel by land to any city, Christian or Muslim [Saraceni] with which Leon has a peace or truce agreement. The goods of those who are dying or die will be secure, but if intestate, the goods will be deposited with Johannes Sisensi archiepiscopus, regis Armenie cancellarius, and will be sent to the doge on his request. Disputes among Venetians will be settled by the Venetians themselves, although if they cannot be resolved, they will be treated in the presence of the archbishop. Disputes between a Venetian and a non-Venetian, including those leading to death, will be heard in the curia regalis. Leon makes an eleemosynary grant to the Venetians of a church and provisions for priests and clergy in Mamistra, together with a fundicum, in which they can store their merchandise, and a site for building a house.
