He confirms whatever belongs to the abbey and its monks, on condition that any property held by one of his knights should remain in that knight’s possession until his death, after which it will revert to the abbey. The names of the casalia are: Husie; Sesie; and others beyond the Jordan that are now held by Turks, Kaharthe; Teletarpe; Pereka; Ayton; Kafarsakai; Naame in monte Panya; Alma de Suchen on the mountains by Tyre; and on this side of the Jordan, Kapharchemme; Kapharseti; Sysara; Lubie and Erpelle; Casta; Mesara; Iubeim; Messa; Capharmater; Caphartamara; Salona; Maluf; Kara; Solem; Elful; Capharmanda; Creisum; Endor; Naim; Buria; Mangana; Noriz; Tubania; Ieluf. He gives the church of St Mary of the Valley of Jehoshaphat a casale called Aschar, situated close by Nablus. The casale is bounded by a valley next to a deserted village/waste land [gastina] called Thera and runs as far as a great valley that leads to Thopas. Among the casale’s dependencies are a gastinula called Fondoch, a market building [funda] in the old city of Sichar, and a land called Dorsum asini, which is near [contra] the casale of Bethphorum. text: Sept. 24 1109 - Mar. 24 1110. After an account of the liberation of Jerusalem, the election of Godfrey [karissimus frater meus] to the office of sancte civitatis gubernator and Godfrey’s death primo principatus sui anno peracto, Baldwin, ab exultante clero principibus et populo primus rex Francorum nutu divino electus atque statutus, describes how he was crowned in the church of Bethlehem and announces that he wanted to raise Bethlehem to the status of bishopric. After consulting Arnulfus archidiaconus and the chapter [of the church of the Holy Sepulchre] in Jerusalem, he sent Arnulfus archidiaconus and Aicardus decanus to Rome for advice. Pope Paschal II ordered Archbishop Gibelin of Arles to hear the case presented by Arnulfus and Aicardus and to follow them to Jerusalem. Gibelin, on the orders of Paschal and with the agreement of the chapter of the church of the Holy Sepulchre, chose and installed Aschetinus eiusdem ecclesie cantor, who had already been elected bishop of Ascalon, as bishop of Bethlehem. [21] Ascalon was subjected to Bethlehem. Confirming this, Baldwin, dei gratia rex Ierusalem Latinorum primus, also confirms the eleemosynary gift [to benefit among others the soul of Godfrey misericordissimus dux] he had made to the church of Bethlehem of the villa of Bethlehem and the following casalia: Bedar in the territory of Acre; Seylon in the territory of Nablus; Bethbazan/Bethbezen/Bethlezen next to Bethlehem; Zeophir/Zoephyr and Carcapha/Carchapha/Carapha in the territory of Ascalon. He has solved the disputes Bethlehem had had with the church of Jerusalem through the exchange of lands and vineyards in the neighbourhood of Jerusalem. He threatens judgement on any who should dispute this grant after his death and promises to confirm any gift to Bethlehem made by his magnates, knights and burgesses [optimates, milites, burgenses]. The charter is dated to the period in which Archbishop Gibelin of Arles, the papal legate, was elected to the patriarchate of Jerusalem. With the approval of Patriarch Arnulf and the barones of the kingdom, Baldwin, dei gratia Latinitatis Iherosolimorum rex, makes an eleemosynary grant, confirming the abbey of St Mary of the Valley of Jehoshaphat together with abbas Hugo in all its lands [in the city of Jerusalem]; and the pool of Siloam and the houses and gardens it has within the walls of Jerusalem. Baldwin confirms its possession of 4 carrucae of land at Jaffa and 2 carrucae at Acre and a casale called Aschar near Nablus. He also confirms the gifts made by others. Lambertus gave a casale called Soesme, situated above the river [Jordan] which is popularly called the river of the Devil, with the consent of Goscelinus princeps Tyberiadis, and Willelmus de Buris, who gave the casale to Lambertus. Barianus constabularius Ioppe gave land and vines in the territory of Jerusalem. Wido de Miliaco, on behalf of himself and his wife Helisabeth, made an eleemosynary grant of lands and vines in the territory of Jerusalem. Radulfus Aliensis gave land situated next to Mons Gaudii and a house and garden in Jerusalem. Eustachius Granerius gave a casale called Capharabra in the territory of Sidon and a house in Sidon; and a casale called Bethalla close to Caesarea and a house in Caesarea.
