Hugo, abbot of St Mary of the Valley of Jehoshaphat, announces to all Christian people that, with the advice of Patriarch Evremar, Cardinal [Ode]risius [of Montecassino], King Baldwin I, and the whole church of Jerusalem, including the canons of the Holy Sepulchre, he has begun to rebuild the church of St Mary of the Valley of Jehoshaphat, which had been so destroyed by the pagans that a Benedictine community cannot be established. He founds a confraternity to help finance the reconstruction. He promises the confratres 2 Masses a week at the tomb of the Blessed Virgin Mary, one for the living, the other for the dead. A long list of confratres contains almost entirely the names of individuals residing in Norman southern Italy, the only possible settlers being Willelmus de Buris and Hugo de Puteolis.

text: Sept. 24 1109 - Mar. 24 1110. After an account of the liberation of Jerusalem, the election of Godfrey [karissimus frater meus] to the office of sancte civitatis gubernator and Godfrey’s death primo principatus sui anno peracto, Baldwin, ab exultante clero principibus et populo primus rex Francorum nutu divino electus atque statutus, describes how he was crowned in the church of Bethlehem and announces that he wanted to raise Bethlehem to the status of bishopric. After consulting Arnulfus archidiaconus and the chapter [of the church of the Holy Sepulchre] in Jerusalem, he sent Arnulfus archidiaconus and Aicardus decanus to Rome for advice. Pope Paschal II ordered Archbishop Gibelin of Arles to hear the case presented by Arnulfus and Aicardus and to follow them to Jerusalem. Gibelin, on the orders of Paschal and with the agreement of the chapter of the church of the Holy Sepulchre, chose and installed Aschetinus eiusdem ecclesie cantor, who had already been elected bishop of Ascalon, as bishop of Bethlehem. [21] Ascalon was subjected to Bethlehem. Confirming this, Baldwin, dei gratia rex Ierusalem Latinorum primus, also confirms the eleemosynary gift [to benefit among others the soul of Godfrey misericordissimus dux] he had made to the church of Bethlehem of the villa of Bethlehem and the following casalia: Bedar in the territory of Acre; Seylon in the territory of Nablus; Bethbazan/Bethbezen/Bethlezen next to Bethlehem; Zeophir/Zoephyr and Carcapha/Carchapha/Carapha in the territory of Ascalon. He has solved the disputes Bethlehem had had with the church of Jerusalem through the exchange of lands and vineyards in the neighbourhood of Jerusalem. He threatens judgement on any who should dispute this grant after his death and promises to confirm any gift to Bethlehem made by his magnates, knights and burgesses [optimates, milites, burgenses]. The charter is dated to the period in which Archbishop Gibelin of Arles, the papal legate, was elected to the patriarchate of Jerusalem. Witnesses: Arnulfus archidiaconus; Aicardus decanus; Eustachius Granerius; Anselmus turris David custos; Radulfus de Fontaneto; Pisellus vicecomes; Simon ducis filius; Anfredus vir religiosus; Girardus camerarius and many others.

Hugo, abbot of St Mary of the Valley of Jehoshaphat, establishes a hospital next to the abbey for the poor and pilgrims, dedicated to St Saviour, funded by a tithe on all St Mary’s goods and supported by a confraternity, the members of which share in the abbey’s prayers and merits. It will feed 13 poor persons on every Feastday of the Apostles and whenever a confrater dies. Another poor person will be fed each day for thirteen days after such a death and on the anniversary each year. Each confrater will provide an eleemosynary subscription of 13 besants a year. The members include domnus Balduinus rex primus; Bernardus episcopus de Nazareth; Guillelmus de Buris; Guido de Miliaco; Goscelinus domnus de Tiberiade; domnus Balianus; and many others.

At the request of the abbot and monks of the abbey of St Mary of the Latins in Jerusalem, which was a hospice serving Latins [Latini], Italians and Lombards when Jerusalem was occupied by the Muslims [Sarracenorum Turcorumque temporibus], Pope Paschal II takes them under papal protection. He confirms their Cassinese Benedictine customs and their use of Roman psalmody. He forbids anyone to enter the abbey without the monks’ licence, other than the patriarch of Jerusalem. The abbot’s election will be according to the Benedictine Rule and no Italian is to be forced on the community. The ordination of an abbot is to be the prerogative of the patriarch of Jerusalem if the elect finds travelling to Rome for consecration difficult. No tithes are to be owed on harvests produced by the monks’ own labour or on oblations or revenues granted to the community. The abbey’s cemetery, and the cemeteries attached to its dependent churches, are to be available to those who wish burial, provided they are not excommunicates. Paschal confirms the abbey in its churches and possessions. The abbots may enjoy privileges granted by them by the churches of Jerusalem and Bethlehem. Papal protection of St Mary has been recognized by the patriarch of Jerusalem.

It will pay no tithes on the products of its own labour. It is free of episcopal procurations in Jerusalem. It can enjoy revenues from infidel peasants [rustici infideles]. Anyone can be buried in its cemetery. It can receive alms on behalf of those who die. It can enjoy parochial rights in its parishes. It can have relations with excommunicates. It is to be secure in its possesions and rights, saving its canonical subjection to the Church of Jerusalem.
