text: Jul. 13. Lateran. Pope Honorius III reports to his legate, Cardinal Pelagius of Albano, that the bishop of Famagusta has informed him of excessive behaviour by the archbishop of Nicosia, who has demanded the presence of his suffragan bishops whenever he visits their churches, when they are only bound to be present on the first occasion. The archbishop allows leave of absence for 2 or 3 years to all who have asisia in churches, without the bishops’ permission, and to enjoy their benefices in absentia, on the basis of a successful appeal made to the pope by Rogerius who had an asisia at Famagusta. He claims the right, on the basis of precedents, to create on his consecration a new canonry in every cathedral without consulting the bishops, although no such precedent has ever been experienced at Famagusta. He has forced the bishop of Famagusta, who had obeyed the papal judge delegates in the case of magister D decanus Nycosiensis against the archbishop’s wishes, into exile, after the bishop had been suspended by the bishop of Paphos and the archdeacon of Famagusta, on the unjust accusation that he had failed to meet the archbishop. He has denied the bishop his jurisdictional power of excommunication, because he had excommunicated certain canons of Famagusta. He has entrusted the administration of the diocese to the archdeacon of Famagusta and to Willelmus canonicus Famagustanus. The pope orders Cardinal Pelagius to reinstate the bishop.

text: Aug. 17. Lateran. Responding to an appeal from the Cistercian abbey of Bellimons, Pope Honorius III narrates for the benefit of the archdeacon of Nicosia, the cantor of Nicosia and magister Balduinus canonicus Nicosiensis the the lengthy dispute between the abbey and Willelmus de Rivet miles Nicosiensis diocesis over the possession of the casale of Peregus, which Willelmus claimed to hold in fief [in feudum] from the queen of Cyprus. The case had been heard by the archbishop of Nicosia, with the authority of Cardinal Pelagius of Albano, the papal legate, but Willelmus claimed that since the casale was a fief it was not subject to the jurisidiction of an ecclesiastical court. Judgement was for the abbey and this was later confirmed when Willelmus persisted in refusing to recognize the court. Willelmus then seized the casale, with the queen’s support, and was excommunicated by the archbishop and the bishop of Paphos, who had been authorized to act by the papal legate. Both parties appealed to the pope, who delegated the case to the archbishop of Tyre and the bishops of Tripoli and Valenia, who were to investigate the matter and decide whether Willelmus’s appeal had been legitimate. Willelmus adopted various subterfuges to evade justice, obtaining a letter from the Holy See to the bishop of Limassol that raised doubt on the status of the case as an ecclesiastical matter, while with the death of the abbot of Bellimons the abbey needed a new procurator. Anxious not to harm the rights of either party, the pope orders the archdeacon, the cantor and magister Balduinus canonicus Nicosiensis to carry out the instruction originally issued to the archbishop of Tyre and his fellow judges.

text: Jan. 10. Lateran. The bishop of Tortosa [Anteradensis episcopus] has complained to Pope Honorius III about the behaviour of the Knights Templar. Lordship of the city of Tortosa is divided between the bishop and the Templars, but the latter, breaking the terms of division laid down a century ago, have ignored the bishop’s lordship [dominium], treating his part as their own, taking control of the city gate that belongs to the church, publicly proclaiming [bannum proclamare] that they have full rights and impeding the operation of the bishop’s meat market [becaria] and the freedom of merchants to sell his grain and wine. They have built 2 new churches in their part of the city, in which they have installed Greek priests [Greci presbyteri] in defiance of the bishop and the Holy See. They have refused to pay their dues, including tithes, to the bishopric, according to the evidence provided by their own rustici Sarraceni, and they have detained tribute paid by [the town of] Coeblum. They have denied the bishop his parochial rights at Castellum Album. The pope gravely rebukes the magister and brothers of the Knights Templar. He orders them to make satisfaction and informs them that he has ordered the archbishops of Tyre and Caesarea and the bishop of Acre to enforce his judgement.

After narrating the history of the discord between the emperor Frederick and citizens of Acre, the visit of the archbishop of Ravenna, and the mediation of the patriarch of Antioch and the magister of the Hospital of St Mary of the Germans, and the excommunication of the citizens imposed by the archbishop of Ravenna, Pope Gregory IX refers to the presence of negotiators on behalf of both the emperor and the citizens of Acre. He is minded to relax the sentence of excommunication and suggests to Frederick that the Holy Land be returned to the state it was in before discord arose between Ricc. Filanger. marescalcus imperatoris and the nobles and barones of the kingdom and the citizens [cives] of Acre, that the cives et sindici Acconenses obey the balivi appointed for the time being by Frederick and his son C. in the maintaining of fortifications, the collection of rents and all customary rights, saving the assises [ascisii] and ancient and approved customs [consuetudines], that they and the nobles dissolve the commune [regni communia], take down the bell and remove the consules and capitanei who had been appointed after the dispute arose, abjuring all oaths made prejudicial to Frederick and Conradus and returning to their fealty. R. marescalcus imperatoris should be restored to the honour of the office of baiulus, but a new baiulus, who is above suspicion, should be appointed by the pope himself before next 1 March. Because there is so much animosity felt towards R. marescalcus, other bauli should administer the kingdom in the interim. Because the kingdom of Cyprus remains disturbed and aid to the Holy Land is hindered, the pope asks the emperor to allow him to mediate, so that the king of Cyprus be reconciled to the emperor or truces can be established.
