In the presence of Patriarch Amalric of Jerusalem, at the mediation of Heraclius archidiaconus Hierosolymitanus and magister Monachus domni patriarche cancellarius, and with the consent of both their chapters, Bernardus Liddensis episcopus and Petrus Dominici Sepulcri prior come to an agreement. Bernardus gives the canons of the Holy Sepulchre half of the tithes taken on harvests, wine, oil, beasts, fowl and other things in a casale called Bermenayn. Petrus concedes to the church and bishop of Lydda half of all the tithes of harvests of the 4 casalia, referred to in a charter of gift from Rogerius quondam Liddensis episcopus, of Capharuth, Git, Kephrecylta and Porfilia. Of these, the first 2 were given and the others exchanged. Exempted from the payment of tithes of all 5 casalia will be fodder for beasts and feeding for fowls, but half tithes will be paid on the products of the canons’ own labour. Bernardus, with the consent of his chapter, gives the canons of the holy Sepulchre the right to churches and the building of new ones in the 5 casalia, with full parochial rights, although the priests [sacerdotes] appointed by the canons should be obedient to the bishop, who retains the right to summon them to a synod, to bless the chrism and oils they need, to consecrate altars and ordain clergy, and to impose interdicts and excommunications. text: Beginning of May - mid Jul. Jerusalem. Henricus Bawarie et Saxonie dux makes an eleemosynary grant for the remission of his sins and those of, among others, his wife Mathilda of England. He establishes 3 lamps [lampades] to burn perpetually in the church of the Holy Sepulchre: one in the Holy Sepulchre itself, one in the Calvary chapel, and the third before the relic of the True Cross. He provides these lamps with an endowment to cover the purchase of oil, by buying, with the agreement of King Amalric, the houses of Michael Furbitor next to the wall of the church of the Holy Sepulchre for 500 besants. These will return rents [censuales] of 20 besants a year. Patriarch Amalric of Jerusalem, who seals this gift, approves it. He and his convent have promised to buy the oil to keep the lamps alight. The abbey of Mt Tabor surrenders the church at casale S. In the presence of domnus Roardus castellanus Jerusalem, his socer, and other probi vires whose names are [in the list of witnesses], Balduinus dominus casalis Sancti Egidii, together with his wife Stephania, assents to the purchase made by domnus Petrus and the canons of the Holy Sepulchre of the houses, buildings and vineyard acquired by the abbot and monks of Mt Tabor, as much from gifts by his ancestors as by purchase and other means. The canons of the Holy Sepulchre will hold these with the same freedom [francicia et libertas] as did the monks of Mt Tabor. Balduinus abandons his dispute with the canons over a house that they already possessed in the casale. This charter is reproduced in duplicate, with Balduinus and canons each keeping a copy. The king makes a sealed eleemosynary grant of an annual rent of 2 quintarii of grapes, collected from his vineyards near the church of the Holy Cross, in return for the tithe of the vineyards next to the church of St Procopius, which his father King Amalric gave to the abbey of Mt Sion in exchange for the lacus Germani, which is for the common use of all the city. Patriarch Amalric of Jerusalem makes a sealed eleemosynary grant to Petrus prior Dominici Sepulcri and his chapter, conceding jurisdiction [juriditio] over a vineyard that had belonged to Petrus de Sancto Jacobo, whose share in it the canons of the Holy Sepulchre had bought. The vineyard is bordered on the east and north by a vineyard belonging to the abbey of St Mary of the Latins. On the west is the royal highway [strata regia] that goes from the leprosary of St Lazarus to the lacus Legerii. On the south is the street [via] that goes from the church of St Stephen to the same highway. The grant is made by the patriarch on the conditions that when he dies, the canons will feed 13 poor persons and 13 clerics to sing psalms for his Requiem; that annually on the anniversary of his death 13 poor persons shall be fed; and that 2 candles, costing 1 besant, should be brought to the patriarchal chapel and lit at Michaelmas.
