[141] Patriarch Aimery of Antioch records under seal the ending of a long dispute between Geraldus Appam[iensis] archiepiscopus and the Hospital of St John of Jerusalem over their respective rights in the casalia of Tricaria and Homedinum. Geraldus and frater Garinus domus Hospitalis preceptor reached agreement in Patriarch Aimery’s presence. With the agreement of his canons, the archbishop surrendered his rights in Tricaria to Josbertus, Hospitalis Jherusalem magister, and Josbertus, with the agreement of his chapter, handed over Homedinum, which had been given to the Hospital by Rogerius de Saona, in its entirety, together with its deeds, to the church of Apamea. The brother chaplain (frater capellanus) at Tricaria is to be exempt in his ministerium from archbishop’s jurisdiction and his office [vicarius] will be held as is customary with Hospitaller vicaries [vicarii] in the Latin East. In the presence of domnus Roardus castellanus Jerusalem, his socer, and other probi vires whose names are [in the list of witnesses], Balduinus dominus casalis Sancti Egidii, together with his wife Stephania, assents to the purchase made by domnus Petrus and the canons of the Holy Sepulchre of the houses, buildings and vineyard acquired by the abbot and monks of Mt Tabor, as much from gifts by his ancestors as by purchase and other means. The canons of the Holy Sepulchre will hold these with the same freedom [francicia et libertas] as did the monks of Mt Tabor. Balduinus abandons his dispute with the canons over a house that they already possessed in the casale. This charter is reproduced in duplicate, with Balduinus and canons each keeping a copy. text: Dec. 25 1177 - Dec. 24 1178. Following mediation by dominus Letardus Nazarenus archiepiscopus and dominus Joscius Acconensis episcopus, dominus Geraldus Tiberiadensis episcopus and his chapter and dominus Johannes abbas vallis Josaphat and his chapter reach agreement in a dispute between the church of Tiberias and St Mary of the Valley of Jehoshaphat over the church of St George in the diocese of Tiberias and over tithes owed on the lands held in the diocese. The monks of St Mary will never receive for purification those who are interdicted or excommunicated by the bishop of Tiberias or parishioners in the diocese. They will bury no one except their brothers, their servants [servientes] and Suriani, nor will they ever baptize or marry Latin Christians, although they can conduct marriages for the Suriani. They may celebrate services with doors closed [in times of interdict]. Married men and women may profess into the religious life with the permission of their spouses. The monks can receive gifts left by anyone to them in their wills; Unmarried men or women [aliquis inuxoratus vel inuxerata] can make gifts to St Mary, saving the rights of the church of Tiberias. The church of St George will present the church of Tiberias 2 rotae of wax [cerei], each weighing 2 rotae every year on the Feast of St George. The church of St George will also render to the church of Tiberias each year 10 besants of good weight in place of tithes. text: Feb. 1-28. At Vadum Jacob. In response to an admonition from Pope Alexander III, Odo Sancti Amancii magister milicie Templi and Rotgerius de Molinis minister Hospitalis Iherusalem, with the advice and agreement of their chapters, resolve disputes between the Temple and the Hospital over moveables and immoveables on this side and beyond the sea. The Templar complaints involve: Cratum; misbehaviour at Mons Ferrantus; looting from Beduini of the Templars perpetrated by turcopoli from Gibelinum; the terra Marriciorum, where it has been agreed that commertium should be divided between the Temple and the Hospital, according to the rights the Hospitallers ought to have; the 3 casalia of Terra Galifa, Banna and casale Bertrandimir, of which Terra Galifa and Banna will remain in Hospitaller hands and casale Bertrandimir will remain in Templar possession. The Hospitaller complaints involve: Gaza; Castellum Arnaldi; Aman; and the commandery [domus] at Barletta, all of which are dismissed. The pope’s advice was that if any dispute should arise in future it should be resolved by a panel consisting of 3 brothers from each side. The masters agree that in such cases commanders from each side, of either commanderies or provinces, should enlist 2 of the more discreet brothers to arbitrate. If these are unsuccessful, friendly outsiders should be recruited and a decision taken by majority vote. In the last resort the details of the dispute should be submitted in writing to the masters for resolution. Brothers who refuse to abide by this should summoned to face the master and chapter in Jerusalem. The agreement is reached in the presence of domnus Balduinus sancte civitatis Iherusalem rex Latinorum sextus, domnus Boumundus Antiochenus princeps and domnus Raimundus, comes Tripolitanus, who append their seals; and of domnus Aldebertus comes Marche; domnus Joicilinus regius senescalcus; domnus Balianus; domnus Rainaldus Sydoni-ensis; domnus Humfredus regius comestabulus; domnus Balduinus Ramatensis; and other barones of eastern Christendom.

Baldwin, per dei gratiam in sancta civitate Iherusalem Latinorum rex sextus, makes an eleemosynary grant, confirming under seal an arbitration in a long dispute between Rogerius de Molinis magister, together with his brothers of the Hospital of St John of Jerusalem, and Rohardus de Chabor over land situated between Beroet and the Tolonum Rohardi de Chabor, which Rohardus unjustly claimed. The king ordered Ioscelinus, his uncle and senescalcus, some brothers of the Hospital - with the permission of Rohardus -, Antelmus de Luca, Radulfus de Nigella and others to walk the ground and measure out the boundaries. Rohardus then publicly renounced his claims. [193] Patriarch Aimery of Antioch records under seal his arbitration in a dispute between the commandery [domus] in Antioch of the Hospital of St John of Jerusalem and the Hospital of St Peter in Antioch. The Hospital had lordship over a mill, situated outside the Porta Ducis between the mill belonging to [the abbey of] St Paul and the patriarch’s slaughterhouse [carcosium]. The Hospital of St Peter held a villein’s holding of 3 millstones [villania trium molarum] in the mill, from which it could take half the profits but was responsible for half the expenses. Over and above this it was bound to provide 4 canons of [the cathedral church of] St Peter with 12 modii of flour and the Hospital of St John with 12 solidi each year on the day after Christmas. The expenses of the mill had been such that the the Hospital of St Peter had failed to make necessary repairs. This led to complaints from frater Roggerius de Larunt preceptor Ospitalis S. Johannis que est Antiochie and other brothers of the Hospital of St John and demands that frater Petrus monachus S. Gildasii [et] magister Ospitalis S. Petri should shoulder the costs, which frater Petrus, coming into the patriarch’s presence, argued it could not meet. Patriarch Aimery finds for the Hospital of St John and, with the advice of his canons Aimericus thesurarius, Leonardus magister scole, Rannulfus, magister Hugo and Helyas, judges that the magister Ospitalis S. Petri should surrender the villania to frater Roggerius preceptor Ospitalis S. Johannis and that the charter granting it should be returned. Frater Roggerius should transfer 300 besants to canon Helyas, who would buy a vineyard for the Hospital of St Peter. Tithes on the mill should always be payable to the church of Antioch.
