Pope Innocent III writes to the patriarch of Jerusalem, the papal legate, concerning a case being heard in Rome, involving magister Iohannes and P. the emissary of the patriarch of Antioch, who had protested over the actions in Syria of the papal legate Cardinal Peter of St Marcellus. On hearing that the archdeaconry of Antioch had been vacant for more than 6 months, Cardinal Peter had ruled that provision had devolved on the Holy See and had granted the archdeaconry to magister Iohannes. The patriarch had responded that he had already offered the office to his nephew and refused to carry out the instructions of the cardinal, who was now in Tortosa [Antaradus]. Cardinal Peter, asserting that the nephew was anyway under age, confirmed his own decision and appointed the prior Bellimontis and magister Milo to instal magister Joannes in the choir and chapter and confim him in his benefices. And, knowing that other canonries were vacant, he had assigned 2 to the clerics Rog[er]ius and Barth[olome]us. The dispute came to involve the bishops of Tripoli and Tortosa [Antaradensis], Marinus Nicociensis archidiaconus and the bishop of Valenia [Valaciensis episcopus] and the journey of W. quondam archidiaconus Antiochenus and the 2 canons to Rome. It culminated in appeals to the Holy See. The patriarch himself pointed to the damage his church had suffered from the prince and citizens of Antioch. He asserted, moreover, that the new archdeacon was uncanonically appointed, because he had been a monk of the abbey of the Holy Spirit at Palermo. Stressing papal rights of provision the pope orders the patriarch of Jerusalem to settle the case.

text: Jun. 27. Pope Innocent III confirms Pope Celestine III’s privilege to the Hospital of St Mary of the Germans. He confirms papal protection and the Order’s possessions, specifying: the location in which the Hospital is situated; a house in Ascalon with its vineyards; Zanzi; houses in Ramla; a house, vineyards and possessions at Jaffa; a house in Acre; the casale of Cafirsin; a volta near the Gate of St Nicholas [Acre]; a house in Tyre; a house in Caesarea; the casale called Bezal/Besal; the curia sancti Georgii on Cyprus; 2 villae in Armenia called Combedefort and Heion. The Order is exempted from tithes on noval lands. Sacred oils, consecrations and ordinations can be performed by [any] diocesan bishop. The faithful can be buried in the Order’s cemeteries if they so wish, provided they are not excommunicated or under an interdict. The Order will follow the practice of the Knights Templar with regard to clergy and milites and that of the Hospitallers of St John of Jerusalem with respect to the care of the poor and the sick. There is to be no violence permitted in enclosure. The elections of magistri should be free.

text: Jun. 4. Viterbo. Pope Innocent III writes to King Leon of Cilician Armenia, deploring the dispute between Leon, his nephew and the count of Tripoli and the resulting danger to Antioch. He has received letters from Leon and his emissaries, the archbishop-elect of Tarsus and a brother of the Hospital of St Mary of the Germans, but complains of Leon’s obduracy in submitting to judgement on the matter and his use of force. Innocent has asked the count of Tripoli to surrender the citadel of Antioch to Patriarch Peter of Antioch, whom the Knights Templar and the Hospitallers of St John of Jerusalem have promised to assist. Innocent exhorts Leon to observe a truce with the count of Tripoli and to return the castle of Gaston, which Leon holds unjustly, to the Knights Templar.

Pope Innocent III informs the patriarch of Jerusalem and the magistri of the Knights Templar and the Hospital of St John of Jerusalem that Joh[ann]es de Sambuco frater Ierosolimitani Hospitalis Sancti Basilii is bringing out on the pope’s behalf 1206 and a half oboles, 9 skifati, 7 marabuttini and 80 unciae in Roman weight of skifati and broken gold pieces, the whole totalling 850 librae Provenienses. The master and brothers of the [Templar house on the] Aventine are despatching an emissary with an equivalent amount of much money. Innocent records that he entrusted 1000 auri librae Proveniensis to be carried by the Knights Templar last year, but has not had any acknowledgement. And he plans to send by means of the Hospitallers of St John and the Knights Templar a further 1400 marcae argenti to be spent as the patriarch and Joh[ann]es Brenensis comes advise. He wishes to provide the patriarch of Antioch with money for his use.

text: Mar. 5. Lateran. Pope Innocent III writes to the patriarch of Jerusalem, the papal legate. He approves the election by the canons of the church of Antioch and the translation to the patriarchate of Antioch of the bishop of Ivrea that resulted from the patriarch of Jerusalem’s mediation. He wishes the patriarch of Jerusalem to confer on the new patriarch the insignia of his office as soon as possible and he expects the two patriarchs to work together in the interests of the Holy Land. Turning to the conflict between the king of Armenia, the Knights Templar and the count of Tripoli, he orders the patriarch of Jerusalem to work for reconciliation and to insist on the observance of truces, given the danger to the Holy Land, while persuading the king to restore the Templar properties. With the ending of the dispute between Duke Philip of Swabia and Otto [of Brunswick], who has gained the [western] empire, he hopes assistance will come. Meanwhile he is sending a large sum of money, to be spent on the needs of the Holy Land by the patriarch, the Knights Templar and the Hospitallers of St John.
