text: May 1-31. Amatus abbas of St Mary of the Valley of Jehoshaphat, together with his convent, records how they sent frater Arnaldus, the prior, and frater Joannes to Antioch on their abbey’s business and to establish what the abbey had owned for a long time. The brothers, wishing to preserve the abbey’s properties in future, found a cleric of Patriarch Peter of Antioch called Joannes diaconus, the son of dominus Helias de Cursalt, who became a confrater. In the presence of the patriarch, Arnaldus and Joannes assigned to Joannes clericus et diaconus one of the abbey’s guastinae, situated next to the house of the Hospitallers of St John of Jerusalem, in which there was a ruined oratory dedicated to the Mother of God. Joannes diaconus promised to repair it so that the brothers of St Mary could worship there. He was bound to build a house and to plant fruit bearing trees and a viridarium in the guastina and also to recover goods of St Mary which had been alienated. The abbot seals a confirmation of the new position of Joannes. Witnesses: Arnaldus prior; frater Adam; frater Petrus; frater Joannes; frater Julianus.

In the presence and with the authority of Patriarch Albert of Jerusalem, the papal legate, John, dei gratia Latinorum Ierusalem rex decimus et comes Brene, makes a sealed exchange with frater Adam ecclesie beate Marie Uallis Iosaphat prior, who has the agreement of his brother monks. The king acquires houses, a garden and all the land that St Mary of the Valley of Jehoshaphat had in Tyre near the Sidon Gate [porta Sydoniensis] and next to the new castle which the king has begun to build and for which the land is needed. In the return the abbey is granted an annual rent of 30 Saracen besants, drawn from the piscaria of Tyre. Any shortfall will be made up from other royal rents in Tyre. In the presence and with the agreement of Patriarch Gerold of Jerusalem, who, together with the abbas de Iosaphat and frater Haymo, seals the charters, the chapter of the abbey of St Mary of the Valley of Jehoshaphat and the chapter of the Hospital of St Mary of the Germans, Radulfus abbas sancte Marie de valle Josaphat and frater Haymo vices gerens fratris Hermanni magistri citra mare domus hospitalis Alamannorum record under seal that Iohannes de Canay/Chanay miles sold to the Hospital of St Mary of the Germans the abbey’s casale called Keissereth/Kassareth and the gastina called Mahus. Iohannes had paid the abbey an annual rent of 30 Saracen besants. Frater Haymo and the common chapter of the Hospital of St Mary of the Germans promise to pay St Mary of the Valley of Jehoshaphat an annual rent of 50 Saracen besants, to be delivered at Martinmas, but in exchange for the rent, they give St Mary of the Valley of Jehoshaphat a house, held from them by Rollandus de Tercenal/Terceval, which returns 24 besants in rent, and a gastina with little houses [domunculae] and logiae, which returns a rent of 26 besants. The house is situated in the platea that stretches to the cathena in the lower vicus [of Acre] near the sea. The gastina borders on the east the gastina of dominus Haymo miles Alamannus. On its west is the public way that runs to the auberge [alberga] of the Hospital of St John of Jerusalem. On the south is a lane [viculus] and on the north the gastina adjoins the curia of dominus archiepiscopus Nazarenus. If for any reason the house and gastina cannot be handed over, the Hospital of St Mary of the Germans will recompense the abbey in an equivalent manner, according to the patriarch of Jerusalem’s arbitration. Gerold abbé de Notre-Dame de la Vallée de Josaphat gives under seal to Nasserus, the son of Henof, and his sisters a pecia terrae, 12 cannes in length and 4 across, in the gastine of Mons Musard. On the east it touches the houses of Michael Le Rempeor and Michael Bastatius. On the west stands the house of Farage syriacus. On the south is the house of David Piscator, while the land stretches to a lane [viculus] that joins the public way, where there is the way out of a house….. next to the mill of Farage. On the north is the entry to the land on common passage [in exitum communem]. Nassarus, his sisters and heirs will pay the abbey of St Mary of the Valley of Jehoshaphat an annual rent of 5 and a half Saracen besants, payable at Martinmas. The land may be sold or alienated to anyone except Knights Templar, Hospitallers of St John and other religious communities, and the abbey retains pre-emption rights. Drawing attention to the expenses falling on the Holy See and referring to a letter written by his predecessor Pope Gregory IX, Pope Innocent IV asks the abbot and convent of St Mary of the Valley of Jehoshaphat to provide what they can to the subsidies [in aid of the Holy Land]. They should hand their contribution to the patriarch of Jerusalem, the papal legate, and the bishop of Tiberias, or their representatives, who can enforce this if need be.
