[193] Patriarch Aimery of Antioch records under seal his arbitration in a dispute between the commandery [domus] in Antioch of the Hospital of St John of Jerusalem and the Hospital of St Peter in Antioch. The Hospital had lordship over a mill, situated outside the Porta Ducis between the mill belonging to [the abbey of] St Paul and the patriarch’s slaughterhouse [carcosium]. The Hospital of St Peter held a villein’s holding of 3 millstones [villania trium molarum] in the mill, from which it could take half the profits but was responsible for half the expenses. Over and above this it was bound to provide 4 canons of [the cathedral church of] St Peter with 12 modii of flour and the Hospital of St John with 12 solidi each year on the day after Christmas. The expenses of the mill had been such that the the Hospital of St Peter had failed to make necessary repairs. This led to complaints from frater Roggerius de Larunt preceptor Ospitalis S. Johannis que est Antiochie and other brothers of the Hospital of St John and demands that frater Petrus monachus S. Gildasii [et] magister Ospitalis S. Petri should shoulder the costs, which frater Petrus, coming into the patriarch’s presence, argued it could not meet. Patriarch Aimery finds for the Hospital of St John and, with the advice of his canons Aimericus thesurarius, Leonardus magister scole, Rannulfus, magister Hugo and Helyas, judges that the magister Ospitalis S. Petri should surrender the villania to frater Roggerius preceptor Ospitalis S. Johannis and that the charter granting it should be returned. Frater Roggerius should transfer 300 besants to canon Helyas, who would buy a vineyard for the Hospital of St Peter. Tithes on the mill should always be payable to the church of Antioch. With the agreement of Count Raymond III of Tripoli, Raimundus de Tribus Clavibus confirms the sale of the terra galifa and Aieslo made by his mother to the magister and brothers of the Hospital of St John of Jerusalem, represented by frater Erchenbaldus Hospitalis preceptor and frater Ermanus Crati castellanus. In return, preceptor Erchenbaldus and the brothers of the Hospital in chapter give Raimundus the 2 casalia of Fauda et Sumessa, for which he will owe servicium to the Hospital according to the customs of the land of Tripoli, together with a gastina called Corcois and the dominium previously held by the Hospital over a terre carucata libera, franca in the same gastina, which Johannes de Fabbrica and his heirs ought to hold. The Hospitallers also give Raimundus for life 5 modii of wheat and 5 modii of barley cum parvo marcibano arearum, and 40 jarrae of wine, which the Hospital had as an eleemosynary gift in the casale of Fauda. The house may be given, sold or pledged to all except churches, milites, Suriani and other peoples who are not obedient to the Church of Rome, but if the intention is a sale the bajulus domorum of the Hospital of St John of Jerusalem must be told and the Order will have preemption rights. Census of 3 and a half besants will be payable each year on the Feast of the Assumption of the Blessed Virgin Mary. The house is situated in vico S. Johannis Evangeliste in the territory of the Hospital [in Jerusalem]. To the east is the rua Ispanie, to the west the rua S. Johannis Evangeliste, to the south the house of Bernardus de Blanchagarda, and to the north the house of Ugo de Romai. The Hospital is paid 2 besants and 2 solidi for its consent to this purchase.
