text: Dec. 25 1177 - Dec. 24 1178. Following mediation by dominus Letardus Nazarenus archiepiscopus and dominus Joscius Acconensis episcopus, dominus Geraldus Tiberiadensis episcopus and his chapter and dominus Johannes abbas vallis Josaphat and his chapter reach agreement in a dispute between the church of Tiberias and St Mary of the Valley of Jehoshaphat over the church of St George in the diocese of Tiberias and over tithes owed on the lands held in the diocese. The monks of St Mary will never receive for purification those who are interdicted or excommunicated by the bishop of Tiberias or parishioners in the diocese. They will bury no one except their brothers, their servants [servientes] and Suriani, nor will they ever baptize or marry Latin Christians, although they can conduct marriages for the Suriani. They may celebrate services with doors closed [in times of interdict]. Married men and women may profess into the religious life with the permission of their spouses. The monks can receive gifts left by anyone to them in their wills; Unmarried men or women [aliquis inuxoratus vel inuxerata] can make gifts to St Mary, saving the rights of the church of Tiberias. The church of St George will present the church of Tiberias 2 rotae of wax [cerei], each weighing 2 rotae every year on the Feast of St George. The church of St George will also render to the church of Tiberias each year 10 besants of good weight in place of tithes. Egidii comitissa, is admitted in common chapter by magister R. de Molinis as a consoror of the Hospital of St John of Jerusalem. She chooses to be buried in the Order’s cemetery. She makes a sealed eleemosynary gift to the Hospital and the poor of the casale of Betheras on the plain of Ascalon, which she had bought with all its rights. She imposes the condition that while she remains in the East the Order will give her 500 besants a year, payable on the Feast of the Assumption of the Blessed Virgin Mary. If she should return to the West, the Order will provide her, in place of the 500 besants, with 12 and half marks in unadulterated silver of Troyes weight, payable each Pentecost in the Hospital’s chapter, meeting at Quierzy [Ceresers] or elsewhere. After her death the Order will bury her as a consoror and commemorate her obit every year. Rogerius, pauperum Christi servus et domus Hospitalis Jerusalem magister, together with his chapter, clerical and lay brothers, records under seal an agreement he has reached with dominus Guerricus Petracensis archiepiscopus at Cratum. In return for the tithes owed on all the Hospital’s properties in the diocese the Order will pay the archbishop 40 besants each year on the Feast of the Holy Cross in September. If it acquires properties in future, it will owe half tithes, with exemptions for animal fodder, vineyards and gardens in which the fruits are harvested at the Hospitallers own expense, although if it acquires vineyards and gardens from which the church of Petra was accustomed to receive tithes, it will pay half of these. Patriarch Eraclius of Jerusalem confirms an agreement, made in his presence and at the orders of Pope Lucius III, between the abbey of St Mary of the Valley of Jehoshaphat and the Knights Templar. He records how his predecessors Patriarchs Arnulf and Warmund gave St Mary under the abbates Hugo and Gelduinus the tithes of 2 royal casalia called Meseraz and Dalphym. Over time these casalia were transferred from the royal domain [dominium regis] into the lordship [dominium] of the Knights Templar, who refused to pay the tithes. The Templars now agree to pay half tithes on wheat, wine, barley, oil, vegetables and also money [byzancii], except the fodder for animals used by themselves, and on gardens and churches, if it should happen that these are established with parochial rights. The agreement has been sealed by the chapters of St Mary and of the Knights Templar. text: 1183. [185] In the chapter of St Paul of Antioch. Falco B. Pauli de Antiochia abbas records the establishment of a fraternal association beween his abbey and that of Mt Tabor, entered into by him and [Johannes] abbas Montis Tabor and some of his brothers. When visiting Mt Tabor the abbot of St Paul will be received as an abbot into the choir and chapter in the absence of the abbot of Mt Tabor and will have the right to absolve brothers from excommunication. The advice of the abbot of St Paul can be offered and his assent will be required, after those of the archbishop of Nazareth and king of Jerusalem, to the election of a new abbot of Mt Tabor. If there is no agreement the electors will make their election in the church of St Paul. When an abbot of Mt Tabor dies his death will be commemorated in St Paul. Monks of Mt Tabor visiting St Paul will be treated as brothers in the church, the abbey, the chapter and the refectory. A monk leaving Mt Tabor after a dispute will be received into St Paul, but he should make confession and be sanctioned there. No one will be received whom has lost the favour of both the abbey and convent of Mt Tabor. The deaths of monks of Mt Tabor will be commemorated in St Paul. If the principality of Antioch should be overrun by the Turci and the prince exiled, the monks of St Paul will be received into Mt Tabor and will be provided for. The abbots and monks of Mt Tabor and St Paul will have the reciprocal rights.
