Pope Honorius III writes to the archbishop of Tyre, recalling that, faced by Venetian contumacy, Pope Innocent III had judged that the church of St Mark in Tyre should be subject to the archbishop, the decree being enforced by the patriarch of Jerusalem, the archbishop of Caesarea and the abbot of Mt Tabor, although he leaves open the prospect of a Venetian appeal.

text: Aug. 22. Narni. Pope Honorius III recalls for the patriarch of Jerusalem and the archbishops of Caesarea and Nazareth Pope Innocent III’s judgement in relation to Tyre, where the Venetians and their vicarii had been exceeding their rights and extending their parochial demands over all living in their third of the city. Innocent had subjected the Venetian church in Tyre to the archbishop, but Patriarch A. of Jerusalem, the papal legate, had died before putting this into effect. The Venetians had tried to claim that the court of appeal in this instance was the patriarchate of Jerusalem, not the papacy. The pope had asked the patriarch, the archbishop of Caesarea and the abbot of Mt Tabor to enforce the judgement, but with Innocent’s death and the abbot’s replacement, Pope Honorius adds the archbishop of Nazareth to the judge delegates who are ordered to enforce the judgement.

[304] Raymond Rupen, Dei gratia princeps Antiochie, Raimundi Rat principis filius, makes a sealed eleemosynary grant to the leprosary of St Lazarus outside the gate of the city of Jerusalem. He confirms the eleemosynary grant made by his grandfather Prince Bohemond [III] of the right to take 1000 eels a year each September within or outside the walls of the city of Antioch. Witnesses: Acharias Antiochie senescallus; Mansellus conestabularius; Thomas marescallus; Julianus Javnvs Antiochie pincerna; Symon camerarius; Willelmus de Hasard; Amauricus de Crosi; Pontius Lombardus; Anfredus de Margato; Americus de Rodanos. [305] After describing the refusal of the count of Tripoli to abide by the papal legates’ judgement, the miseries of warfare, and the hopes for Raymond Rupen, his nephew and the legitimate prince of Antioch, Leon, per Dei et Romani imperii gratiam rex Armeniae, recounts for Pope Innocent III how he approached Antioch with his army and entered the city without any bloodshed. Raymond Rupen was received as legitimate prince at the cathedral by the patriarch, who gave him the vexillum principale and paid liege homage [ligium homagium] to him, as did the milites and clientes belligeri at the palatium. Then the barones, milites and burgenses who had been exiled were restored to their possessions. Leon agreed to restore [to the Latins] the church of Tarsus [Tarsensis Ecclesia], for which the patriarch had consecrated as archbishop the cantor Antiochen. Ecclesiae, and the church of Mamistra [Manustana Ecclesia], which he recognized to be a suffragan see of the patriarchate and to the archbishopric of which was elected the archidiaconus Antiochiae. The fons Gustoni was restored to the abbey of St Paul. The abbots of Nigra Montana had their casalia and holdings restored and the Knights Templar were given back the castellum of Gastum, which Leon had acquired from the pagani and had detained because of the needs of warfare. Leon reports that there is now peace in the land, as the pope will learn from the Knights Templar, the Hospitallers of St John and other religious, should he enquire. Leon asks for aid and the promise of indulgences for those who come to the assistance of Cilician Armenia and Antioch.

text: Oct. 25. Lateran. At their request Pope Honorius III takes N. abbas monasterii Sancti Theodosii Cenobiarce de Laberia and his brothers under papal protection. He confirms their religious life according to the rule of St Basil and their possessions, which he specifies as follows. In Jerusalem they have the place [locus] in which the monastery is situated, together with the church of St Theodosius with a hospital [hospitale], shops [apothece], an oven, vineyards in the 2 monasteries of St John the Baptist and St George; lands at Ramla; lands and a vineyard with a hospital at Ascalon [Scalona]; outside Jaffa the church of St Jonah and within the town shops [apothece] and a hospital with a large vineyard; the right to have 2 ships free [of dues] in the sea off Jaffa; an obedientia at Zevel, together with the church of SS. Peter and Paul and all the market place [forum] with shops [apothece], and a hospital, and a casale. There then follows a list of properties in Hungary. Since the Greeks [Greci] were not accustomed to pay tithes, the pope grants the monastery freedom from the payment of tithes on lands held before the Fourth Lateran Council, which the monks cultivated themselves or provided animal fodder, but tithes will be payable on lands acquired after the council that will be farmed by others. The monastery may receive postulants. The diocesan bishop will be responsible for providing chrism and other holy oils, the consecration of altars and churches and ordinations. The monks are freed from observance of interdicts. Crime is forbidden within enclosure. The election of abbots should be free.
