Petrus prior Dominici Sepulcri records that, together with some of his canons, he travelled from Jerusalem to Antioch to investigate the rights enjoyed by the church of the Holy Sepulchre in the time of the Greeks [Greci] and then under the Turks [Turci]. He found 2 mills, one standing, the other ruined, on the banks of the River Orontes at the head of the bridge leading to the Gate of the Count [of the city], which the Holy Sepulchre had once owned by hereditary right. Having investigated the matter with lord Raymond [of Poitiers], princeps ejusdem civitatis, and husband of Constantia and having taken evidence from elderly Suriani, it was agreed to put the 2 water wheels [duas rotas a parte fluminis] at [one of] these mills, called Funeidec, into the custody of three Suriani called Nicheforus, Michaelis and Nicholas for them and their heirs to hold in feodo villaniᶒ on condition that they meet the expenses in materials required in rebuilding the mill and the barrage [exclusa] for the mill race. In return they will have half of all the profit they make from milling and from fishing, although the division of produce between them and the Holy Sepulchre will only take place in the presence of the canons’ famulus, who will hold the key to the mills. If the mill should be damaged the Syrians will rebuild it; on a third refusal to rebuild the mill will be confiscated. If a miller is convicted of theft he will repay either in marcibans or in besants. If he cannot repay the money will be expropriated by a canon or by the canons’ famulus. The villania cannot be sold or pledged without the permission of the chapter of the Holy Sepulchre. text: Apr. 19. Antioch. Raymond [of Poitiers], Dei nutu princeps Antiochenus, records how in the third year of his principate [1139] he made a pilgrimage to Jerusalem. While visiting the Holy Sepulchre, he was informed by Patriarch William, by Petrus Dominici Sepulcri prior, and by the whole community there of injuries long suffered by the church of the Holy Sepulchre in Antioch. They asked for the restoration of their rights. Raymond promised justice in his curia. On his return from Jerusalem, the prior of the Holy Sepulchre, accompanied by Wlgrinus prepositus and some brothers, came to Antioch on 1 February [1140] and accused the community of the abbey of St Paul of depriving the Holy Sepulchre of a garden and some land a long time ago. The complaint was put to Robertus cenobii Sancti Pauli abbas and his community, who unanimously declared that this was a case for the patriarch of Antioch, since it was an ecclesiastical, not a secular one, particularly as the garden had been exchanged by Patriarch Bernard for a house belonging to Stephanus thesaurarius ęcclesię Sancti Pauli. The abbey had in its possession a charter of exchange, confirmed by Prince Bohemond II. The authenticity of the document was questioned when it was presented. It was decided that the case could be held in the prince’s curia. The court was summoned for 30 March at Pons Ferri, outside Antioch, where Raymond was encamped [in castris] and again on 2 April in the prince’s palatium in Antioch. The canons of the Holy Sepulchre were present, but the monks of St Paul were not. Raymond took advice from his barones and reconvened the court for 13 April. On that occasion Guiterius de Mozo and Ricardus de Belmont, standing among the barones, solemnly summoned the abbot and monks of St Paul. Since they refused to appear before the court and plead, the canons of the Holy Sepulchre, whose case had been proved by the evidence of elderly Greek [Greci] witnesses called Gregorius ᶒcclesiᶒ Sanctᶒ Mariᶒ cantor, Thomas subcantor, Michael filius Molkim/Molkem and Abraham filius Sucar, were invested with the disputed property on 15 April. The ruling is confirmed by Prince Raymond and his wife Constantia principissa. Outside the city walls they are: 2 mills to the west of the Gate of the Bridge [porta Pontis], of which one is a building and is called in Arabic Funeidic and the other has lain in ruins for a long time; and a vineyard once owned by Bruno platearius. Within the walls they are: an apotheca situated before the Bath House that is called Omar in Arabic; a deserted house, anciently called of Berutus and situated before the church of St Menna; a house, called Serice, which is next to the church of St Peter; a house situated in front of the house Serice, which was once possessed by a Greek [Grecus] canon of the Holy Sepulchre called Salomon; all the houses, situated in front of the hospital [hospitale] called Hebeneboleit, which extend from the oven of Sanctus Georgius Discoopertus to the road that runs to the church of SS Cosmas and Damian. Prince Raymond adds more recent gifts to this list: a house given in alms by Osmundus canonicus Antiochenus, situated before the Bath House of Tancred; the house of Gameliel presbiter, Sancti Sepulcri canonicus, situated near the church of St Leonard; a house that belonged to a layman called Benedictus, facing the church of St Symeon.
