In the presence of Raymond II, comes Tripolitanus Poncii comitis filius, Guillelmus Tortosanus episcopus, having spoken to his chapter and to Count Raymond, together with the barones and burgenses of his curia and others, has asked Ebrardus magister templi and his brothers to build and occupy a new castle in Tortosa, which was taken by the Turks [Turci] and burnt, and remains deserted and destroyed with its holy places profaned, in order to assure more security and to ensure that the cathedral church of Mary, the holy mother of God and perpetual virgin, can be renewed. On the Templars’ agreement, episcopus Guillelmus and his chapter give them a part of the town in the bishop’s possession where burgenses used to live. They will build a castle there, from the entrance to the Gate as far as the house of Guillelmus de Tiberiade and as far as the Gate of St Helena. All the churches in the city with the parish rights, whether within or without in the port, are to be subject to the church of Tortosa and its bishop, except for the Templars’ own chapel in the castle of Tortosa. The churches the Templars have or will acquire in their castles and elsewhere in the diocese will be held by them freely with all parochial rights, except for those at Marraclea, Camelum, Exerc, Colea, Castrum Novum, Cratum and Lacum. Tithes of the Templar churches will be shared between the bishop and canons of Tortosa and the Templars, except for tithes of demesne [proprius laboris fratrum templi], of spoil gained in military expeditions and of those levied on animals and gardens, all of which the brothers will keep, and except for the tithes of Cratum, which have been wholly given by the bishop to magister Raimundus and the brothers of the Hospital of St John of Jerusalem. All returns from villani and milites will be tithed and shared, except for all those of Castrum Album, which will go to Templars and all those of Marraclea, which will go to the see of Tortosa. Baldwin, per gratia dei in sancta civitate Iherusalem Latinorum rex quartus, gives the commune of Marseille under seal a church, oven and rua in Jerusalem, Acre and all the ports of his kingdom, together with freedom to enter and leave, buy and sell without paying dues. He gives this in recognition of the assistance rendered by the commune in the taking of the territories of Jerusalem and Tripoli. In return for the contribution of 3,000 besants made by the commune to the capture of Ascalon and Jaffa, King Baldwin gives Marseille a casale [casellium] on the boundary between Ascalon and Jaffa called Ramie with all its rustici and animals. The king’s gift is reinforced by the promise of the papal legate, Patriarch G. of Jerusalem, Radulfus episcopus Bethleem and all the bishops to excommunicate all who would challenge it. Baldwin, per gratiam dei in sancta Ierusalem Latinorum rex quartus, confirms under seal the agreement made on his orders by Girardus de Valentia with the Latins [Latini] newly established in Casale Huberti de Paci. Girardus has given the colonists [incolae], who he has placed there, houses to be held by hereditary right. The Latins will render to King Baldwin a 7th part of the harvest of the land [fructus terre] which has been assigned to them to work, keeping 6 parts for themselves. They will render to the king a 15th part of the bread baked in the oven, and a 10th part of anything else cooked there. Whenever they bathe in the bath house they will each pay half a denarius. They will pay 1 denarius as a weights and measures tax [pro mensuratione] for each besant’s worth [bisantiata] of whatever they buy in relation to the casale. They can sell bread, wine, meat and other things in Acre without paying any dues. They can use the mill of Ferge 3 days and nights each week, saving royal rights. The cultivators of vineyards and gardens, which Giraldus de Valentia leases out on the king’s behalf for periods of time will render the king a fourth part of the fruits, keeping 3 parts for themselves, and the tenants of olive groves, assigned each a part by Giraldus, will collectively render two-thirds of the fruits to the king, keeping a third part for themselves. Sales of houses and lands in the casale will be respected, but in every sale 1 carrupla in the besant will go to the king.
