If God grants him Latakia he promises the Pisans free occupation of a vicus called the Voltae Prodromi, which runs in one direction as far as [the church of] St Nicholas and in the other to the seashore and Iron Well [puteus ferreus]. He allows their ships [naves et galeae] to visit the port of Latakia. The Pisans can enter and leave whenever they wish without paying any dues or customs. He also gives the Pisans the vicus Sancti Salvatoris in the city of Antioch and general freedom throughout all his land and ports. The agreement is confirmed by: B. Felicis de Gerunda and Petrus de Podii Laurentii. Raymundus had shown the bishop charters of gift made by Count Raymond [of St Gilles], and Arbertus episcopus and Pons episcopus, and confirmed in papal bulls of privilege. Bernardus makes an eleemosynary grant, giving Raymundus Hospitalis pater and his brothers the tithes of all the property the Hospitallers own in the diocese of Tripoli, except for half the tithes returned in the parish of Artussia, together with the tithes of the mills of Guillelmus Berardi. The Hospital is to retain the tithes of the bishopric of Archae as long as it has possession of the church there. P[etrus] Dominici Sepulcri prior and his convent record that they conceded to Bernardus and his wife, who had been received into the confraternity of the Holy Sepulchre, a house with a statio, to be held for their lives, with the exception of 2 camerae and stables [stabulae], which the canons of the Holy Sepulchre will retain for the lodging of Lambertus Ptolomensis. After the death of Lambertus and his wife the Holy Sepulchre will provide Bernardus with compensation. If Bernardus and his wife decide to abandon their property and enter the community they will be provided with food and clothing. When one of them dies half of their goods will go to the Holy Sepulchre and the survivor may join the community with the other half or can continue to live in the house. After the survivor’s death the house and statio will pass to the the canons. If Bernardus and his wife should have a child he or she will inherit one third of any cash, but the rest, together with the house and statio, will pass to the Holy Sepulchre. If the survivor of the couple remarries he or she should have the property for life, but it will not be held by any new wife or husband after the survivor’s death, although she or he may retain half of any cash. If there is a child of this second marriage the cash will be divided, with a third going to the Holy Sepulchre, a third to the child, and a third to the spouse. Record of an agreement made between Maria de Sancto Lazaro, the wife of Rogerius, a cliens of the Holy Sepulchre, and Bernardus, the brother of Petrus prior Sancti Sepulcri and a cliens of the patriarch. Maria had wedded her daughter to Bernardus in the presence of the chapter of the Holy Sepulchre. Her first husband Petrus had presented the daughter with a dowry of 100 besants and had invested her with the usufruct of a vineyard that he had planted. Petrus also left Bernardus a fourth part of a house situated in Jerusalem in the platea Templi next to the house of Bentulinus, to be held after his death. Another part was left to his son, although it would pass to Bernardus if the son died. Maria challenged the gift of the house. The case was heard in the chapter of the Holy Sepulchre in the presence of patriarcha Willelmus; Petrus subprior; of the canons of the Holy Sepulchre, Anselmus cantor; Goffridus thesaurarius; magister Robertus; and in the presence of Anschetinus, quondam vicecomes Hierosolymitanus; Rainaldus de Pontibus; Goiffridus Acu. They judged that Bernardus should have the fourth part of the house acquired by Maria and her second husband Rogerius after their death; similarly another fourth part should pass to Bernardus after the death of Maria’s son. They are to hold it under the same terms as he held it from Bohemond II. The houses are situated next to those of Pontius Antiocheni thesaurarius on the other side of the public way [via publica]. Riso reserves for himself one camera, to provide a small living place [habitaculum] for his servus, whom he has had baptized, for as long as he lives and serves him faithfully. Petrus Dominici Sepulcri prior, together with the canons, gives Arnulfus, the son of Bernardus/Bernaldus Syrianus, and his heirs houses built over vaults exchanged with the Hospital [of St John] and situated over the Holy Sepulchre’s oven, which is on the road that leads to Mt Sion, and a statio next to the oven for an annual census of 9 besants, payable at Easter. If the bases of the houses resting on the vaults are damaged, that party, the Holy Sepulchre or Arnulfus, which has been negligent will be responsible for repairs. If Arnulfus extends the houses and wishes to sell, the Holy Sepulchre will have preemption rights, paying 1 silver mark less than the price. Otherwise any purchaser, burgensis vel Syrianus, will be subject to the same rent. The cost of any repairs to the statio will be borne by Arnulfus. The canons give custody of the key to the cistern to Arnulfus, who must provide the procurator of the oven with water if he needs it when making repairs. Rainald [of Châtillon], Dei gratia Antiochenorum princeps, together with Constantia eorumdem principissa, gives the church of St Mary and the archbishop of the city of Pisa, together with all the people from the province of Pisa living in Antioch, represented by their legate Butato, land on which to build a house in the port of Latakia. This land extends below the church of S. Helias, [running] before the houses of the Temple and of magister Ugo to the sea, and along the beach as far as a tannery [teneria] and the old wall and as far as the ditch. If by the judgement of a court the Pisans can recover land in the port that Willelmus Embriacus has occupied, the land described above will be restored to the prince. Rainald also gives the Pisans a house in Antioch, which had belonged to dominus Odo de Tyro. He remits half of all duties levied on Pisan imports and exports, sales and purchases. He assures the Pisans of his protection. The Pisans’ goods will be safeguarded in shipwrecks and the possessions of those who die in the principality will be returned to their relations intact. The Pisans may settle disputes among themselves in their own court, but if any dispute arises with one of the prince’s subjects the case will be dealt with in his court. The charter, fortified with the prince’s seal, was drawn up by Gaufridus cancellarius principis. Baldwin, per gratiam dei in sancta Hierusalem Latinorum rex quartus, with the advice and agreement of his mother Queen Melisende, seals a peace treaty with the Pisans, who renounce all the claims on confiscated goods that they have brought against him and his homines, except for those relating to their honores that they are pursuing against the patriarch of Jerusalem, the clergy [clericatus] of Caesarea and the abbot and monks of St Mary of the Latins. The king, on his behalf and on that of his homines, renounces all claims and confiscations made against the Pisans. The Pisans promise to keep security and faith [salvum et fidum] with the king. They will protect him and his subjects homines by sea and land and will do their best to prevent other persons harming them. The king makes the same promise of security, protection and faith to the Pisans. King Baldwin excludes from this agreement the sale in Egypt of iron, wood, pitch, [pix] or arms, which can be confiscated without breaching the treaty. The king gives the Pisans a viscounty in Tyre, the holder of which can judge the Pisans in their own court [curia], reserving only to royal justice cases involving death sentences [traditio mortis]. He gives the Pisans 5 carrucate of good land next to Tyre and an oven in Tyre. He confirms King Baldwin II’s grant to the Pisans of 5 houses in the ruga next to the port of Tyre free of rent [tributum vel redditum] and freedom from taxes on their shipping [naves] and goods in the port, although pilgrims and other men (who are not Pisan merchants) would not be exempt. The goods of Pisans who died would not be subject to any restrictions or taxation. Baldwin wishes his brother Amalricus comes Ascalonitanus to make peace with the Pisans.
