Bohemond III, son of Raymond late prince of Antioch, makes an eleemosynary grant to Girbertus Hospitalis magister and the brothers of the Hospital of St John of Jerusalem, confirming all the endowments made in alms by his father Prince Raymond and the other princes and barones throughout the land of Antioch. He adds the gift of a ship [grippus] on the lake [of Antioch], with the freedom that his barones of Antioch already enjoyed, and the house of Barutellus in Antioch, which Barutellus and his wife Sarracena left in alms after their deaths. He confirms all the gifts [beneficia] made to the Order, with the proviso that a knight’s fief [feodum militis] should not be diminished and his curia does not lose servicium. He specifies: a house in Antioch with a garden next door, near the church of St John Chrystostom [Johannes Os Aurie]; a canuta in vico Malfetanorum; a domuncula with a garden in vico S. Pauli. Outside the city of Antioch, the casalia of Assis, Ursan and Melessis, which were given by Prince Bohemond I; the casale of Balilas in the territory of Harenc; the casale of Churac in the territory of Aironia; the casale of Cisemburg in the territory of Turbassellum; the guastina called Aganir before Tilium; the casalia of Cadir and Ubrie; the casale of Sarata in the territory of Mamistra; the casale of Muserac in the land of Cafardan. Prince Bohemond III also confirms: all the properties in the city of Latakia given by Prince Rainald and his predecessors, specifically the baths which are before the house of the Hospital; and the gastina Danielis and the gastina Ugonis Bernardi which were given by dominus Robertus de Surdavalle. Bohemond III gives the Hospital a garden next to its house in Latakia and a rent [assisia] of 40 besants, drawn annually from the tannery [taneria] in exchange for 3 estaconi on the seashore in Latakia. He gives the turon de Beauda with 3 neighbouring gastinae in the territory of Gibellum. He gives a garden within the walls of Gibellum, where the brothers may erect houses. He confirms the gift from Robertus Manselli of a vineyard beyond the spring, with 3 carrucate terre nearby. In addition he gives the Hospital in Gibellum 5 carrucate terre. The Hospitallers ought to have 13 marcibani of wheat and 4 litrae of oil from every harvest [menses (sic)]. They should collect the wheat from the threshing floors [arei (sic)] and the oil from the presses [masseri]. He also gives a rent [assisia] of 50 besants a year from the revenues of Latakia, [made up of] 14 denarii from the taneria, 14 besants from the tentureria and the remaining besants in oleum fossimani. He gives the Hospitallers freedom to come and go with their goods throughout the principality exempt from the payment of dues [consuetudo et exactio curie]. Bohemond III son of Raymond, the late prince of Antioch, having lordship over Latakia and Galadum, makes a sealed eleemosynary grant to the church of St Andrew of Amalfi and all Amalfitans, confirming all their possessions. He gives them the right to half of all consuetudines and jura with the freedom to come and go and sell and buy. He also gives 3 estracones in the city of Latakia, freed from servitium and with the right to build whatever they want on them. The estraconi/estacines are bounded on the east by a road, on the west by the sea port, on the south by the church of Sanctus Petrus de platea and on the north [a media nocte] by the house of a Surianus called Asset. The gift is made to Landulfus comes Mauro and Luca de Floro, who give Bohemond 1300 besants in return. [108] Bohemond III, Dei gratia princeps Antiochenus, records under seal how after the death of Petrus Gayus, burgensis principis, his creditors sued in the prince’s curia for repayment from his property. Such was the size of the debts that the curia decreed that they could only be repaid by the sale of his immoveable goods. For some days the auction of these was advertised in Antioch, with a reserve of 3200 besants. Bartholomeus de Moissac offered 6200 besants. The creditors would be repaid from these. Bartholomeus had already paid 1777 Saracen besants to Petrus Gayus [Bartholomeus ex prop[r]io suo Petro Gayo reddiderat et emendaverat]. Bartholomeus is to have the property [hereditas] in conjunction with the Hospital of St John of Jerusalem, which he chose to be his partner in this deal. The property consists of the gastina S. Basilii, which belonged to Michael Magnus, Georgius Raiz and Theodorus notarius ducis, to whom Petrus Gayus paid annually de dimos 4 besants to Michael, 2 besants to Georgius Raiz and 2 besants to Theodorus. Neighbours of the gastina are the vineyards of Boordiz, the gastina S. Machabeorum and the gastina S. Simeonis, which Aimericus Richerius possesses. Adjacent is a pecia terre which had been the property [hereditas] of Michael Magnus, bordered by a river [fluvius] on the west. On the other side are the vineyards of S. Georgius, Hugo Darena and Alexander de Porta. Prince Bohemond gives the pecia terre and the gastina, with a tower and other buildings, and wasteland and vineyards nearby which belonged to Petrus Gayus, and the rent from other vineyards leased to other people, to Bartholomeus and the Hospital of St John, to be shared equally. They may sell or pledge the properties to whomsoever they wish, including churches and religious communities, provided the dimi of 8 besants is paid annually to Bohemond’s homines. He remits half of all the consuetudo that Venetian merchants were accustomed to pay in the principality of Antioch. He gives them free carates and assures them of security when travelling in, entering and leaving Antioch and all his land. Their merchants [negociatores] will not be hindered in consequence of any offence [forifactus] perpetrated by their men at sea or elsewhere. If any Venetian ship [navis] is wrecked on his coast the Venetians will suffer no loss. They may hold their own court [curia] in their fondicium/fonditium in Antioch, to which they will alone be answerable, and they may make judgements and resolve disputes according to their own laws. He gives Rochefort with an abbatia, Cava, Levonia, Tala, Bachfela, Gaigon, Glorieta with a spring that waters the gardens, casale S. Egidii with the torone de Belda, half of Rogia together with the other half which Bohemond has acquired from Reinaldus Masoerius and his heirs, Arcicant, Farmith, Femia with its lake, Logis, Bochabes with the casale de Pailes; other lordships and liege lordships [dominationes et liggianciae] that Femia has in Syria, Berssaphut, castellum de Lacoba and Totomota. With the consent of the inhabitants, Bohemond concedes all these, together with his lordships and liege lordships in them, with the agreement of those who have rights, feoda and heritages. The Hospitallers can make war and peace with neighbouring Muslim powers as they please and, when notified, Bohemond will observe them. On the other hand neither he nor his homines will make treaties with the Sarraceni, nor with any Christians allied to them, without the advice of the Hospitallers. If the Hospitallers are not consulted they can react as they please. They can enjoy all the proceeds of the spoils of war. Bohemond confirms the privileges granted by his father of free import or export of goods without the payment of any tax [consuetudo et exactio curie] All gifts made by his homines will be confirmed, provided that the number of knights’ fiefs [feodum militis] are not lessened and his curia loses servicium. [115] Bohemond III, son of Prince Raymond, Dei gratia princeps Antiochenus, makes a sealed grant, giving Guido Falsart, his homo ligius, a ninth part of an assisia within Antioch of 700 besants that Guido held and agreed to give to Bohemond for the land which, together with the prince’s own, was granted by Bohemond to the Knighthood of the Temple and the Hospital of St John of Jerusalem. In return for the ninth part of the assisia, Bohemond confirms Guido’s possession of the gastina called Dendema, which he received on his marriage to his wife Clementia, and he gives Guido the land that is between the gastina of Dendema and the public way to Pons Ferri and includes the gastina Putei. The road provides one boundary; the other, facing towards Antioch, goes through the hillside [dividit eam totus collis] following the public way as far as the fluvium Ferri. He specifies: a ruiga with the church of St John in Antioch, which is between two streams [aquae] and has the road [via] on each side; a fundicum, a ruga and everything else they have in Latakia, together with a third part of the revenues [redditus] of the port; a third part of the revenues in Suidinum. He promises a response to complaints or justice with 40 days, unless hindered for a good reason; and in that case emendment with 15 days according to the usus et institutiones of his curia. He gives [freedom from] conmertium in all his land and in any territory he acquires with Genoese assistance. He promises security of Genoese persons and possessions. [125] Bohemond III, the son of Prince Raymond, Dei gratia princeps Antiochenus, with the agreement of his wife domina Orgollosa principissa, confirms under seal for the church of St Mary, the archbishop, consuls, senators and members of the commune of Pisa and its province residing in his principality land to build a house in the port of Latakia. This land extends below the church of St Elyas, before the house of the Templars [domus Templi] and the house of magister Ugo, as far as the sea, and along the seashore as far as a tannery [taneria] and the old wall, and in the upper part as far as the ditch. If the Pisans by the judgement of court [iudicium curie] can recover the land in the port occupied by Hugo Embriacus, the son of Willelmus, the land now given will revert to the prince. Bohemond gives in addition a house in the city of Antioch that belonged to dominus Odo de Tyro. He assures the Pisans of the security of their persons and goods in case of shipwreck and of the property of those who should die, except when they are intestate. He remits half of all taxes [medietas totius iuris] customarily paid on entry and departure, coming and returning, buying and selling, throughout his territory and he assures them of his protection. Disputes between them can be settled in their own court [curia], but if a case cannot be decided, or involves theft, predation, homicide or the subjects of Antioch, it will decided in the prince’s court.
