Patriarch Albert of Jerusalem, the papal legate, rules on a dispute between Helyas, son of the late Paganus Pictaviensis, and Girardus, preceptor hospitalis Theutonicorum, over a house, situated within an enclosed group of houses of the Hospital of St Mary of the Germans, which Helyas claims was his own. Accepting 25 besants from the [preceptor] Helyas renounces his claims. text: Mar. 5. Lateran. Pope Innocent III writes to the patriarch of Jerusalem, the papal legate. He approves the election by the canons of the church of Antioch and the translation to the patriarchate of Antioch of the bishop of Ivrea that resulted from the patriarch of Jerusalem’s mediation. He wishes the patriarch of Jerusalem to confer on the new patriarch the insignia of his office as soon as possible and he expects the two patriarchs to work together in the interests of the Holy Land. Turning to the conflict between the king of Armenia, the Knights Templar and the count of Tripoli, he orders the patriarch of Jerusalem to work for reconciliation and to insist on the observance of truces, given the danger to the Holy Land, while persuading the king to restore the Templar properties. With the ending of the dispute between Duke Philip of Swabia and Otto [of Brunswick], who has gained the [western] empire, he hopes assistance will come. Meanwhile he is sending a large sum of money, to be spent on the needs of the Holy Land by the patriarch, the Knights Templar and the Hospitallers of St John.

Appealed to for justice by the emissaries of King Leon of Cilician Armenia, the abbas Sancte Maria Triumarcuum, Arciuardus miles and Bouo latinus cancellarius, Pope Innocent III orders the bishop of Cremona [episcopus Cremonensis] to travel to the East and to find 2 suitable men to hear the case and put an end to the dispute between the king, his nephew R. and the count of Tripoli, compelling the parties by armed as well as ecclesiastical sanctions if necessary. If the bishop cannot find any suitable judge delegates, he should recruit the patriarch of Jerusalem, who is papal legate, and the patriarch of Antioch.

Pope Innocent III has heard that the legitimacy of the election by the chapter of Nicosia of magister Durandus eiusdem ecclesie thesaurarius to the archbishopric has been challenged by many, including Galterus de Monte Beliardo, a parishioner. Durandus has claimed that this challenge is motivated by the animosity Galterus has for the king. The pope does not have enough evidence. He asks the patriarch of Jerusalem to judge the case. If he finds for the elect he should consecrate him and confer the pallium.

The record of the arbitration by Patriarch Albert of Jerusalem on a dispute between Martinus Rozia, a citizen of Genoa, and frater Hermannus, magister hospitalis Alamanorum de Acon, over a house in Tyre that had belonged to the late Theodorus Surianus. The patriarch rules that frater Hermannus should give Martinus Rozia 60 properly weighed Saracen besants of Syria. Martinus accepts, provided the gold coins are properly weighed, and surrenders to frater Armannus the charter he has that relates to the house. Witnesses: Galterius Acconensis episcopus; frater Lodoicus; Aldo ecclesie sancte crucis de Accon canonicus; Obertus Aurie; Nicholaus Spinola.

text: May 18. Lateran. Pope Innocent III reminds the papal legate, the patriarch of Jerusalem, that he had already ordered him to judge in the dispute between the king of Cilician Armenia and the Knights Templar over the castle of Gaston and other issues. The Templars were prepared to submit to judgement, but the king had refused to accept their approach and had occupied by force their property in portus Bonellus and in other places in Armenia, which provided them with much of their sustenance, installing guards [custodes] in their houses. The patriarch had ordered the king to withdraw his guards and had excommunicated him, warning the inhabitants of, and pilgrims to, the Latin East to do nothing to assist him. The king then seized all the Templar possessions in Cilician Armenia, except for 2 castles which he could not occupy, and destroyed Templar casalia in the principality of Antioch to deprive their castles of provisions. Knights Templar and their companions had been wounded and killed. Innocent is writing to the patriarch of Antioch, the archbishop of Tyre and the bishops of Sidon, Tripoli, Tortosa [Anteradensis], Limassol and Famagusta, and King John of Jerusalem, confirming the excommunication of the king of Cilician Armenia and ordering them to publicize it.

text: Apr. 12. Acre. In the bishop’s palatium. Patriarch Albert of Jerusalem, Gualterus episcopus Acconensis and Andreas vicecomes Venetorum arbitrate in a dispute between Simon Rufferius vicecomes Januensium in Accon, representing his commune, and Bonacurtius Anselmeti consul Pisanorum in Accon, representing his commune, over the burgesia of Agnes Gastaldi, which Simon claims belongs to the commune of Genoa because it is situated in the ruga S. Laurentii, which is leased out by the commune. Bonacurtius, on the other hand, maintains that the commune of Genoa can claim nothing from Agnes other than the rent [census], because she has had the house for a very long time. The arbitration is as follows. The Genoese vicecomes and jurati curiae suae stress that they bear no ill will towards Agnes, who had sold part of the house without their permission. They now confirm the sale on condition that the purchaser, Lucensis the widow of Bartholomaeus de Dominis, pays them a rent of half a besant a year. The rest of the house remains in possession of Agnes, who, together with her relations the sons of Ubertus de Maria, pays a rent of 10 besants a year to the commune. Agnes and Lucensis will answer to the vicecomes and his curia de Burgesia, as do other burgenses. The agreement is ratified by Bonacurtius consul Pisanorum in Accon, with the agreement of Simon Chimicosus, Burgundius de Bandino, Sanutus, Loterius Bubeus, Moroneus and other Pisans; and by Simon, the [Genoese] vicecomes, with the agreement of the consules Januensium Jacobus Mallon and Otho de Insulis, together with Marinus de Bulgaro, Guillelmus Busce, Rubaldus de castello and other Genoese, together with the jurati curiae Januensis, magister Otho Fulcherius, Jacobus de Angla, Obertus Astalibeta and Jacobus de Roduan, who swore to abide by the agreement, which is sealed with the seals of the arbitrators.

He has heard from Iterius, a canon of the church of Antioch, that his uncle Patriarch Peter, who had suffered persecution and died, had given him and his brother 1000 Saracen besants to be spent on their education [in studiis scholasticis]. But the present patriarch, on receiving the money from the magister of the Hospital of St John of Jerusalem, with whom it had been deposited, not only did not grant it to Iterius and his brother, but also deprived him of the fourth, with which the old patriarch had augmented his prebend with the consent of his chapter, and had confiscated a gastina called Naria and refused to grant them the revenues, amounting to 1000 besants [aurei]. These had been transported to the castle of Cursarium in the custody of the dean of Antioch. Innocent orders the patriarch to investigate and if need be ensure satsfaction.

text: Feb. 28. Lateran. Pope Innocent III reprimands the king of Cilician Armenia for his excesses in the principality of Antioch, his violation of treaties and his promises. The pope has heard from the patriarch of Antioch and many others that the king had broken his written commitment to a truce, had sent his nephew Raymond Rupen with a large army into the territory of Antioch, had ravaged and burnt casalia belonging to the churches and carried off loot amounting to more than 100000 besants. Leon had received a man who had been deposed as patriarch of Antioch. He had replaced the archbishop-elect of Tarsus [Tarsensis] with a Greek, expelled the Latins and divided the church’s possessions among his milites. Innocent warns the king that he has ordered the patriarch of Jerusalem, his suffragans and the bishops of Cyprus to enforce the excommunication of the king, his nephew and his supporters until satisfaction is made. He has forbidden the kings of Jerusalem and Cyprus, the Knights Templar, the Hospitallers of St John of Jerusalem and any peregrini in the province of Jerusalem to have any relations with those who have been excommunicated.
