Pope Gregory IX informs the preceptor and brothers of the Hospital of St Mary of the Germans in Acre that according to the terms of the agreement reached between the emperor Frederick and the subjects of the kingdom of Jerusalem, the prince of Antioch is to become bajulus and hold all the land, including the city of Tyre. But the citadel of Tyre is to be held by the Hospital of St Mary of the Germans on behalf of the emperor and his son Conrad.

text: Feb. 21. Viterbo. Pope Gregory IX informs the emperor Frederick of the result of negotiations in his presence between the magister of the Hospital of St Mary of the Germans, representing the emperor and his son Conrad, and Henricus de Nazareth miles Acconensis and Ph. de Trecis miles Acconensis, representing the nobles and citizens of Acre and others in the kingdom of Jerusalem. Frederick and Conrad will enjoy all the rights of the crown as they existed before the discord arose. Their balivi will be obeyed in the management of castles and offices, the collection of rents and other rights, known to accrue to the crown by custom, saving the ancient assisii and approved customs of the kingdom. The opponents of Frederick will dissolve the commune, take down its bell, dismiss the consules and capitanei appointed since the discord arose and swear fealty. Riccardus Filangerius will be restored to the office of bailli [baiulatio], but he will appoint another who is above suspicion on the advice of O. comestabulus Acconensis to rule until next September. From then on, the prince of Antioch will be instituted baiulus on Frederick’s authority. Swearing to abide by the customs of the kingdom, the prince will hold all crown rights in the kingdom of Jerusalem, together with the city of Tyre, although the citadel of Tyre will be held by the magister and brothers of the Hospital of St Mary of the Germans. If the prince of Antioch cannot or will not accept the office, the emperor will appoint the comestabulus Acconensis as baiulus, with the powers already described. Should the need arise to replace him, another baiulus, who is above suspicion in the eyes of the liegemen of the kingdom [homines ligii regni], will be appointed to serve until Conrad comes of age. In return the emperor will assure all in the kingdom, clergy and laity, nobles and citizens of Acre, of his grace. His favour should extend to Iohannes de Ibylino, his sons and supporters, and all living in and coming to the kingdom, including merchants, but safe-conducts will not be extended to Iohannes de Ibylino, his sons and nephews, specifically Iohannes de Cesariis and the other Iohannes de Ybelino, should they travel outside the kingdom. Any case brought against Iohannes de Ybilino or his followers will be judged according to the customs and assisii of the kingdom. The pope adds that he has ordered the bishops of Acre and Chieti to denounce those who do not hold to their promises and he encourages Frederick to observe this agreement. He writes in similar terms to the magistri and brothers of the Hospital of St John of Jerusalem, and the Hospital of St Mary of the Germans, the preceptor and brothers [in Acre] of the Hospital of St Mary of the Germans, O. comestabulus Acconensis, B. dominus Sydonis, Iohannes de Cesariis, the nobles and citizens of Acre and others in the kingdom of Jerusalem, and the bishops of Chieti and Acre.
