Pope Alexander IV writes to Patriarch [Jacques Pantaléon of Jerusalem], papal legate, and Archbishop [Gilles de Saumur] of Tyre, relating that he has heard that some of the faithful of the Kingdom of Jerusalem have left some of their goods in their last wills solely for the construction of the walls of the cities of Jerusalem and Ascalon (Ascholona) and of certain other places in the Holy Land. Because it is not hoped at present that these cities and places will be recovered, and it is feared that with time or even the death of those who hold these bequests they will be lost, and because the Holy Land, it is asserted, is in no little danger from invasion by the Mongols (Tartari), the pope orders the addressees to have those bequests handed over to them, forcing those who hold them with ecclesiastical censure, if necessary, after a warning, appeal put aside, so that the addressees spend the money for the fortification of cities and castles and for the defence of the Holy Land as they deem expedient.

text: April 1 – 30. Acre. Florentius, bishop of Acre, and the chapter of his church. A dispute has arisen with William of Chastel Neuf (Guillelmus de Castronovo) and his convent over a house which had belonged to Philippa, late wife of Guillelmus Capenegre, located in vico balnei S. Johannis. On the east it is bounded by a certain Hospitaller curia; on the west is the public road; to the south is a house belonging to the Hospital which had belonged to the late Philippa; to the north the entrance to the Hospitaller aforementioned curia. The bishop claims it is his by virtue of a grant made by Philippa whereas the Order says it is theirs by virtue of a sale or grant by Guillelmus Capenegre. The parties have reached a composition on the basis that the bishop and his successors will receive an annual rent of 40 Saracen besants payable in two equal instalments on the kalends of January and the kalends of July. If the Hospitallers occupy the house for their own use, they will pay the bishop 10 Saracen [besants] on the dates specified. Witnesses: Adam the archdeacon, Bernardus the cantor, Johannes the treasurer, and Gerardus, canons of Acre (Acconenses).

Pope Alexander IV writes to the bishop of Beirut (Beritensis), relating that Patriarch J[acques Pantaléon] of Jerusalem, papal legate, humbly asked the pope to assist him with the expenses he went to in coming to the Apostolic See and staying there and also traveling, since he is obliged to his creditors for no small sum of money and he must go to further expense as befits the burden and honour of his rank. The pope therefore orders the master and brothers of the house of the knighthood of the Temple of Jerusalem to give and assign to the patriarch without any trouble up to 100 marks sterling from the sum of money that the late Patriarch G[erold] of Jerusalem deposited in their house at Acre. If they do not, the addressee is ordered to compel them to do so with ecclesiastical censure, after a warning, without appeal, various obstacles notwithstanding.

Pope Alexander IV writes to Patriarch [Jacques Pantaléon] of Jerusalem, papal legate, relating that the latter told him that in his province clerics often bring cases against laymen over real estate in the ecclesiastic courts, but the laymen take exception that, because the items are held by royal fief of the Kingdom of Jerusalem, they are not obliged to respond in the ecclesiastical courts, especially since they are prepared to pay the bailli of the kingdom the dues for these things and to respond before him, who is not negligent or remiss in dispensing justice. It is countered that when the dispute concerns these things not qua feudal and those who seek these things do not admit that they are feudal, the person who is claimed to be the feudal lord should not judge, but the ecclesiastical judge should know these cases, especially since the throne is presently vacant. For although the bailli can do many things, by the custom or assisia of the kingdom the bailli himself cannot judge concerning a royal fief. The patriarch asked the pope’s advice, and the pope replies that if the clerics take to the ecclesiastical courts cases over real estate against laymen and the laymen object that these things are feudal, and it is known or proven to the judge that this is so, the cases are to be referred to the lord of the fief. If there is a custom or assisia in the kingdom on the matter, however, the patriarch as legate can decide in order to protect the rights of the churches and ecclesiastical persons.

Pope Alexander IV writes to Bishop [Alberto Boschetti] of Moderna (Mutinensis), relating that Archdeacon Bartholomeus of Tripoli, papal chaplain, informed him with his petition that he was received as canon in the church of Reggio (Regina) on the authority of a letter of the patriarch of Aquileia (Aquilegensis), then papal legate in Lombardy, but he had not yet received a prebend, since he had lost the pertinent letter and instrument because of the disturbance of the past time. Thus Pope I[nnocentius IV] ordered the then bishop-elect [Guglielmo da Fogliano] of Reggio (Reginus) that, if he remembered the reception, he should grant the prebend if one is vacant or as soon as possible, removing any illicit holder. Although the bishop committed his role to Godo de Ganaceto (Bourel de La Roncière wrongly has “Godo et Ganaceto”) canon of Moderna (Mutinensis) and admitted that he was present at the reception, Bartholomeus has not yet obtained anything. The pope orders the addressee to make sure that the bishop follows through.

text: June 22. Viterbo. Pope Alexander IV writes to Archbishop [Hugo] of Nicosia (Nicosiensis), relating that, since many clerics of his city and diocese have been struck with the canonical sentence for laying violent hands on secular clerics, out of concern for the spiritual health of his subjects, the archbishop asked the pope to grant him license to absolve them. The pope thereby grants Hugo license to absolve twenty of them, according to the form of the Church, after they have made fitting satisfaction to the sufferers for their injuries, as long as their infractions are not serious enough to merit the clerics being sent to the Apostolic See, provided that the expenses they would have incurred for a journey to, stay at, and return from the Apostolic See are applied to the aid of the Holy Land.
